Recently medical doctor was killed by the patient’s violence against him. Violence has been rampant in doctor’s office and emergency room at the medical center. Assault on a doctor and rape or sexual violence has been gained much media coverage. Traditionally the relation with medical doctor and patient was based on trust. The relation between both sides has being changing. Most people think it as contractual relationship, therefore, they tend to think a medical treatment as a service, while most medical doctors still tend to expect patient’s trust. World Health Organization European Consultation on the Rights of Patients declared the “Principles of the rights of patients in Europe” in 1994, which regulates that “Everyone has the right to respect of his or her person as human being”. Furthermore, World Medical Association also declared “I will respect the autonomy and dignity of my patient” in . In this article, I will describe the actual condition of assault and sexual violence between medical personnel and patient, and current law and related current proposed legislation, especially, Assault Prevention Act against Medical Personnel and then I will suggest the measure for prevention of violence.

근래 우리 사회에는 진료실이나 응급실에서 의사가 환자에게 폭행당하거나 살해당한 사건, 환자가 의사에게 진료를 받다가 성희롱, 성폭력을 당한 사건이 빈발하고 있다. 과거 신뢰를 기초로 하였던 전통적인 환자와 의사의 관계는 흔들리고 있다. 환자와 의사의 관계는 시대의 변화로 말미암은 의료계약을 기초로 한 계약관계로 이해된다. 그러나 환자의 생명이 의사에게 달려있고 의사를 선택할 시간적인 여유가 더 이상 환자에게 주어지지 않을 때는 예외이다. 의사는 의료의 특수성을 근거로 환자에게 의사에 대한 신뢰를 기대한다. 생각건대, 의료행위의 특수성상 필연적으로 환자의 신체에 대한 침해가 수반되는 의사의 의료행위는 환자의 신뢰가 전제되어야 한다. 이 관계는 물건을 돈을 주고 거래하는 매매와는 성격이 다름은 누구나 부인할 수 없다. 그리고 의료영역의 특수성 또한 부인할 수 없다. 다만, 이러한 특수성을 존중하되, 의사에 대한 신뢰와 존중 뿐 아니라 환자의 존엄이 존중되어야 하고, 의사의 의무로 환자에 대한 인간존엄을 명시하고 이것이 지켜져야 한다. 본고에서는 의료계에 끊임없이 문제가 되는 폭력의 실태와 이를 개선하기 위한 법안을 살피고, 대응방안을 제시하였다.
