The participatory trial was introduced more than a decade ago. It has quantitatively achieved much performance, though it may be reluctant to evaluate that the system is firmly established in the Korean justice system. There is a general consensus that it is at risk or at least stagnant. This paper sympathizes with the critical mind for the participatory trial system but focuses on whether the interests of the accused are well guaranteed in this system. The reason why the accused's interest is important is that the participation trial begins with only his application. The implementation of the system will vary depending on which case the accused in the case applies for a participatory trial. At present, it is hard to say that the accused of serious crimes actively applies for a participaory trial. The reasons need to be analysed from the accused's point of view. In addition, this article has proposed several solutions based on the previosly mentioned problems. The reformation of the physical environment of the court, the guarantee of a attorney's more efficient assistance, and the improvement of the proceedings of the trial will allow the accused to apply more actively for a participatory trial. Hopefully, this will help the participatory trial system contributes the higher values.

국민참여재판 도입이 10년을 넘어섰다. 그간 국민참여재판은 양적인 측면에서 많은 성과를 이루었다. 그런데도 이 제도가 우리 사법제도 내에서 확고부동하게 자리 잡았다고 평가하기에는 주저가 드는 것도 사실이다. 국민참여재판이 위기라거나, 적어도 정체 상태에 있다는 점에는 일반적인 공감대가 형성되어 있다고 생각된다. 본 글에서는 이러한 문제의식을 공유하되 특히 피고인의 이익이 국민참여재판에서 잘 보장되고 있는지를 중심으로 논의한다. 피고인의 이익이나 입장이 중요한 이유는 국민참여재판이 피고인의 신청으로 시작되기 때문이다. 어떤 사건의 피고인이 국민참여재판을 신청하느냐에 따라 이 제도의 시행 모습은 달라진다. 현재로서는 중대범죄 피고인이 적극적으로 국민참여재판을 신청한다고 보기는 어렵다. 그 이유를 피고인의 시각에서 검토해 볼 필요가 있다. 더불어 이 글에서는 앞서 문제점을 바탕으로 몇 가지 해결책을 제안하여 보았다. 법정의 물리적 환경 개선, 변호인의 충실한 조력권 보장, 공판절차의 진행 효율화 등을 통해 피고인이 좀 더 적극적으로 국민참여재판을 신청할 수 있도록 할 수 있을 것이다. 이를 통해 국민참여재판 제도가 더욱 높은 가치 실현에 이바지할 수 있기를 희망하여 본다.
