The purpose of this study is to examine the legal basis, utilization of collected information through the V-pass system and infringement on fundamental rights in connection with the leakage and abuse of personal information, which has become a hot issue recently, and to propose the need for legislation on the use of the collected information. The following measures are proposed through the analysis of the laws, fundamental rights and the use cases of the collected information through the V-pass system. First, it is necessary to apply the statute reservation principle strictly for the legislation on the use of collected information through the V-pass system and the delegation of the law is required in order to act as a police action with restrictions on individual freedom and property rights. Second, the provisions concerning the collection, use and notification of information through the V-pass system shall be newly established in the Fishing Vessels Act. It is meaningful to ensure fundamental rights of collected information and to minimize limitations of fundamental rights by specifying the items, use and notification of the collected information through the V-pass system. This study has limitation in that it did not analyze the quantitative comparison between the fundamental rights of infringed subject and the rights and interests to protect in using the collected information.

이 연구는 최근에 많은 이슈가 된 개인정보의 유출 및 남용과 관련하여 어선위치 발신장치를 통해 수집된 정보에 대한 실정법적 근거, 활용 및 기본권 침해에 대하여 고찰하고, 수집된 정보의 활용에 대한 입법 필요성을 제안하고자 함에 그 연구목적 이 있다. 어선위치발신장치를 통해 수집된 정보와 관련된 법률, 기본권에 대한 고찰 및 수집 정보의 사용 사례의 분석을 통하여 다음과 같은 개선방안을 제시하고자 한 다. 첫째, 어선위치발신장치 수집정보 사용에 관한 입법을 위해 엄격한 법률유보원칙 적용이 필요하며, 개인의 자유와 재산권의 제한을 가져오는 경찰 작용을 하기 위해 서는 반드시 법률의 수권을 필요로 한다. 둘째, 어선법에 어선위치발신장치를 통한 정보의 수집, 이용, 통지에 관한 조항을 신설해야 한다. 어선위치발신장치를 통해 수 집되는 정보의 항목, 이용, 통지를 구체적으로 규정함으로써 정보 주체의 기본권 보 장과 그 제한을 최소화 할 수 있도록 하는데 의의가 있겠으나, 수집된 정보를 이용 함에 있어, 침해되는 정보 주체의 기본권과 보호하고자 하는 권익의 정량적인 비교 를 분석하지 못했다는 점에서 한계를 지닌다.
