The Korea Coast Guard has implemented ‘professional detective system' since February 2019. At a time when the investigation power is about to be adjusted, whether or not ‘professional detective system' will be successfully settled in the Coast Guard organization has a very important meaning. It is a national demand and the duty of the Coast Guard to fully investigate crimes and strengthen investigative capabilities to do so on the condition that independent investigative power is exercised. Depending on the success or failure, it could be an opportunity to take the organization to the next level, or a crisis that loses public trust and becomes the subject of criticism. Therefore, in this article, we wanted to derive what tasks were necessary for the success of the investigation task. The National Police Agency has already implemented ‘professional detective system' in 2005. Since the Coast Guard's is basically modeled on the NPA's system, its assessment could be a good suggestion. Based on my working experience and the police agency's prior research and evaluation of ‘professional detective system' , this study sought tasks and alternatives for the success of the Coast Guard's ‘professional detective system'.

해양경찰청은 2019년 2월부터 수사경과제를 시행하였다. 수사권조정을 앞두고 있 는 시점에서 해경조직에 수사경과제의 성공적 정착 여부는 매우 중요한 의미를 갖는 다. 독자적 수사권의 행사를 전제로 범죄에 대한 완전한 수사의 책임과 이를 위한 수사역량 강화는 국민적 요구이며, 해경의 의무라고 할 수 있다. 성패에 따라서는 조 직을 한 단계 발전시킬 수 있는 기회가 될 수도 있고, 국민의 신뢰를 잃고 비난의 대상이 되는 위기가 될 수도 있을 것이다. 따라서 이 글에서는 수사경과제의 성공을 위해 필요한 과제가 무엇인지 도출하고 자 하였다. 해경의 수사경과제가 기본적으로 2005년부터 실시된 경찰청의 제도를 모 델로 하고 있으므로 그에 대한 평가는 좋은 시사점이 될 수 있을 것이다. 이 연구는 필자의 실무경험과 경찰청의 수사경과제에 대한 선행연구 및 평가를 토대로 해경의 수사경과제 성공을 위한 과제와 대안들을 모색하였다. 그 중에서도 가장 중요한 두 가지는 수사경과자들의 전문성을 어떻게 확보할 것 인가와 수사경과가 일반경과와 조직 내에서 어떻게 융화하며 조직의 안정성과 협조 체제를 해치지 않고 정착하게 할 것인가의 문제라고 할 수 있다. 전문성의 확보 문 제는 전문성을 갖춘 인재의 선발, 선발 이후의 교육과 업무수행을 통한 전문성의 유지 및 제고, 인사와 승진 등의 모든 문제를 포괄하는 개념으로 매우 어렵고도 중요 한 과제이다. 또한 수사권조정과도 관련되어 수사권이 해경에게 주어질 경우 독자적 수사권을 가지고 범죄에 대응하는 해경의 책임수사와 역량을 보여줄 조직적 사명이 부여된 것으로서 매우 중요하게 인식되어야 한다. 아울러 전문성 확보의 토대 위에 수사경과가 해경 조직 내에서 일반경과와 괴리되지 않으면서도 전문성을 갖춘 중요 부서로서 조화롭게 기능을 수행할 수 있도록 해야 할 것이다.
