This study is the first national simultaneous president election on March 11, 2015 and the second national simultaneous president election research on March 13, 2019. The Commission recognized the seriousness of the election crime in violation of the ｢Act of Election commissioned by the Public Organizations｣. It is a study to find limitations and improvement plan of police for clean and correct election culture. Police cracked 671 elections in the first and 436 election crimes in the second. However, since the second election is over, more incidents are expected. This indicates the seriousness of the violation of the 'Commissioned election law', which means that the role of the police to prevent and control these election crimes is important. Based on these problems, this study analyzed the actual condition of the commissioned election crime and limitations of the police response. And the improvement plan was derived. As a result, we intend to establish a clean electoral culture. It is also a starting point for previous studies and may be expected to follow up on.

본 연구는 2015년 3월 11일 실시된 제1회 전국 동시조합장선거와 2019년 제2회 전국 동시조합장 선거에서 발생한 ｢공공단체 등 위탁선거에 관한 법｣ 위반 선거범죄에 대한 경찰의 대응과 개선방안에 대한 정책적 연구이다. 위탁선거범죄의 특성에 따른 위법선거운동은 지속적 증가추세에 대해 관계중독의 경향을 토대로 원인을 분석 하였다. 그 결과 관계중독 관점에서 지연, 학연, 혈연 등과 직장 혹은 지역사회라는 특성이 위탁선거범죄를 조장한다고 할 수 있다. 중앙선거관리위원회와 경찰의 노력에도 깨끗하고 올바른 선거문화가 정착되지 못하고 있다는 점에서 아쉬움이 남는다. 전국동시조합장선거에서 경찰은 제1회 671건과 제2회 436건의 선거범죄를 단속하였고, 제2회 선거는 끝난 직후여서 더 많은 선거범죄 발생이 예상된다. 이는 ‘위탁선거법’ 위반의 심각성을 나타내는 수치이며, 이러한 선거범죄를 예방하고 단속하는 경찰의 역할이 중요하다는 점을 의미한다. 이 연구는 이러한 문제점을 바탕으로 위탁선거 범죄의 실태와 경찰 대응의 한계점을 분석하고 공직선거와 다른 위탁선거의 위법선거운동에 대한 원인을 당선에 따른 중독화 현상의 결과로 인식하여 추 후 개선방안을 도출하였다. 이 연구 결과를 바탕으로 다음 치러질 제3회 전국동시조합장선거에 깨끗한 선거문화 정착을 도모하고자 한다. 또한 선행연구로서의 시발점이라는 점과 후속 연구의 기대도 있다.
