This paper analyzes the economic effects of the right to collective action, focusing on the effect on wages and employment, in order to review whether the right to collective action corresponds to the improvement and maintenance of working conditions, such as wages, which are intended to be enacted. Group bargaining based on collective action makes the labor market a monopoly rather than a bilateral monopoly, creating a negative effect on wages and employment as follows: First, it raises wages above the market wage level in the union sector, creating lay-offs or reducing recruitment of new employees. Second, labor supply increases to the non-union sector, lowering the wage level in the non-union sector. Third, as more unions are established, wages in the non-union sector decline sharply and the tendency of permanent or semi-permanent mass unemployment is increasing. Therefore, wage increases based on the right to collective action benefit some workers at the expense of other workers. Therefore, the right to collective action, which is guaranteed by the Constitution to improve workers' working conditions, is not only inconsistent with the purpose of the enactment, but also counterproductive, given that the right to collective action is a means to sacrifice a large number of workers for the benefit of a small number of workers.

본고는 단체행동권이 제정 취지인 임금 등 근로조건의 개선 및 유지에 부합하는지를 검토하기 위해, 단체행동권의 임금 및 고용에 대한 영향을 중심으로 단체행동권의 경제적 효과를 분석하였다. 단체행동 권을 기반으로 하는 단체교섭은 노동시장을 쌍방독점이 아니라 오히려 공급독점으로 만듦으로써 다음 과 같이 임금과 고용에 부정적인 효과를 발생시킨다. 첫째, 해당부문에서 시장임금수준이상으로 임금을 상승시키면서 해고자를 발생시키거나 신입사원의 충원을 감소시킨다. 둘째, 비노조부문으로 노동공급이 증가하여 비노조부문에서의 임금수준을 하락시킨다. 셋째, 노조의 설립이 많아질수록 비노조부문에서의 임금은 형편없이 하락하면서 영구적 혹은 반영구적 대량실업이 초래될 경향이 점점 더 커진다. 따라서 단체행동권을 기반으로 한 임금인상은 타 노동자들을 희생시켜서 일부 근로자들이 혜택을 본다. 그러므 로 근로자들의 근로조건 향상을 위해 헌법에 보장된 단체행동권이 오히려 소수의 근로자들의 이익을 위해 다수의 근로자들을 희생시키는 수단이 되고 있다는 점에서 단체행동권은 제정 취지에 부합하지 않을 뿐만 아니라 오히려 역효과를 발휘하고 있다고 할 수 있다.
