The Land expropriation and compensation system in Korea was bimodal to “ACT ON SPECIAL CASES CONCERNING THE ACQUISITION OF LANDS FOR PUBLIC USE AND THE COMPENSATION FOR THE LOSS” which had resulted in a continuous controversy. To solve this issue, a single legislation ‘ACT ON ACQUISITION OF AND COMPENSATION FOR LAND, ETC. FOR PUBLIC WORKS PROJECTS’(Abbr.: Land Compensation Act) was enacted in 2003.1.1. Land Compensation Act is the basic law on land expropriation, which the standards and procedures for the loss compensation was systematized as well as improving a number of systems considered illogical. This leads to a meaningful fact that it faithfully protects people’s right of property, along with driving a public utility project more efficiently. This research covers mainly the recently amended Land Compensation Act, followed by its legal basis and the background and the analysis of issues which resulted in amendments.

종래 한국의 토지수용과 손실보상에 관한 제도에 관하여는‘토지수용법’과 ‘공공용지의 취득 및 손실보상에 관한 특례법’으로 법제가 이원화되어 이로 인한 논란이 계속되었다. 이를 해결하고자 2003.1.1. ‘공공용지의 취득 및 손 실보상에 관한 법률(약칭:토지보상법)’이라는 하나의 법령이 제정되었다. 토지 보상법은 토지수용의 기본법으로, 손실보상에 관한 절차와 기준을 체계화하 고 각종 불합리한 제도를 개선하였다. 이는 국민의 재산권을 충실히 보호함 과 아울러 공익사업의 효율적인 추진을 도모할 수 있다는 점에서 의의가 있 다고 할 것이다. 이 연구는 최근 개정된 토지보상법의 주요 내용을 중심으로 토지보상법의 법적 근거 및 개정에 이르게 된 배경 및 문제점을 분석하였다.
