Crimes committed on marine vessels are not easy to report immediately and gather evidence when crimes occur because of the closeness and isolation of vessels. Subway and bus among Korea's means of transportation have been made mandatory regulations for the installation of CCTVs. The effect of CCTVs in vessels can be used as preventative effects on crimes and proof of trials. Overseas, IMO(the International Maritime Organization) legislated the ISPS Code after the after the Sept. 11 terrorist attacks terrorist attacks to enhance the security of vessels and port facilities. This regulation recommends or enforces the installation of CCTVs in international vessels and port facilities. In the United States and Japan as well as South Korea, there are laws on international vessels and port facilities that comply with IMO's international rules. There is no law the installation of CCTVs in vessels on our country. However, I think the legislation of law is urgently needed to ensure for the safety of the people and prevent vessel crimes. This study introduces standard products and installation methods suitable to the characteristics of the sea for the stable installation and operation of CCTVs in vessels, and proposes the management and operation of CCTVs based on the Privacy Act. In addition, The government and local governments should lower the burden of expenses through budget support and allow them to be effective management after installing CCTVs through cooperation with private organizations.

육지와 달리 해양선박 내부에서 발생된 범죄는 바다라는 접근적 어려움과 그 위 를 항해하는 선박 내라는 제한적 공간에서 범죄가 이루어진다는 특수성으로 인하여 범죄가 일어날 경우 해양경찰 등 사법기관에 빠른 신고가 어렵고, 범죄수사와 입증 증거자료의 확보도 쉽지 않다. 최근 국내 운송수단 중 지하철은 2014년 관련 법률의 개정에 따른 법률 통과로 의무적으로 CCTV를 설치하도록 하여 운영하고 있다. 그리 고 버스내부의 CCTV 설치 의무화는 올해부터 법률이 시행된다. 하지만 국내선박을 대상으로 해양선박내부에 CCTV설치를 의무화한 법률은 발견하기 어려웠다. 외국의 경우 IMO(국제해사기구)에서 선박 및 항만시설의 보안강화를 위해 9.11테러 이후 ISPS Code를 제정하여 ‘국제선박 및 항만시설 보안규칙’을 마련하여 국제선박과 항 만시설에 대한 CCTV설치 등의 보안규정을 권고하거나 강제 설치하는 규정을 두고 있다. 우리나라 뿐 만 아니라 미국과 일본 등 대부분의 외국에서도 관련 규정에 근 거하여 국제선박 및 항만시설에 관한 법률과 보안규정을 마련하여 운영 중이다. 본 연구에서는 해양선박 내부에 CCTV 설치의무화의 필요성을 해양범죄의 특징과 기대 효과 측면에서 나누어 보고 사전적으로는 범죄 예방적 효과와 범죄 발생 후 형사소 송법상의 증거확보차원에서 효율적인 수단으로 CCTV의 설치 의무화필요성을 제시 하였다. 그리고 설치된 CCTV는 개인정보보호법의 기준에 따른 법률위반이 발생되지 않도록 설치의무화에 따른 효율적 운영방안과 관리 등을 제시하였다. 특히 육상의 CCTV제품의 설치기준과 운영사례를 참고하여 선박용 CCTV에 필요한 인증제품과 설치공법 등의 표준기준안의 제정, 설치의무화에 따른 개인부담의 경감을 위한 정부 및 지방자치단체의 예산지원, 민간분야와의 협력, 사후관리 매뉴얼 등을 통한 효율적 운영을 통해 해양선박 CCTV설치의 본연의 목적달성에 맞는 효율적인 운영이 되도 록 제언하였다.
