This study is researched about a problem of Gando with systematic method. Also it shows the direction to solve from a practical standpoint between Korea and China's territorial dispute regarding Gando area. Japan has barged on this territorial dispute regarding Gando area for their purpose and then made two agreements with China(Chung). One was agreement of Gando and the other was agreement of Manchuria. These two agreements are based on six proposal about three area in the northeast by Japan. Japan have passed Gando area to China(Chung) and then acquired rights of railways and mining in Manchuria from China(Chung) in these agreements. Japan-Korea Protectorate Treaty was made between the Empire of Japan and the Korean Empire in 1905. But the Korea(Joseon)'s Emperor Gojong had not accepted, so that Korea scholars continuing to insist that all treaties are already annulled by Japan instead of Korea. As a matter of course these are included agreement of Gando between China(Chung) and Japan. The Korean Government can insist on ownership of Gando area according to international law and has a proof sufficiently but did not so yet because a prime reason is North Korea. The Korean Government must keep a file on historically authenticated document and arrange their an attitude to prepare upcoming unification of Korea in the future.

본 연구는 통일 한국이 해결해야 할 과제인 ‘간도문제’를 체계적으로 분석하고 문제 해결을 위한 방향을 제시하였다. 청·일간에 맺어진 ‘간도협약’은 두만강을 구 한국과 청의 국경으로 인정하고 두만강 이북의 개간지(간도)에 구한국인의 거주를 승인함으로써 간도지역을 구한국의 영토에서 제외시켰다. ‘간도협약’은 ‘만주협약’ 과동시에 체결되었는데 이 두개의 조약은 일본이 먼저 제안한‘동삼성육안’을 근 간으로 한 것이다. ‘간도협약’으로 청은 간도영유권을 확보하였고 일본은 ‘만주협 약’으로 만주철도부설권과 무순, 연대의 탄광 채굴권 등을 가짐으로써 대륙침략의 기회를 마련하였다. 한국은 을사보호조약이 일본의 강박에 의해 체결되었고 고종 황제의 서명이 없는 조약이기 때문에 원천적으로 무효이며 이것에 의거해 청·일간 에 체결된 간도협약은 인정할 수 없다는 입장이다. 간도지역은 한국이 영유권을 주장할 충분한 근거를 가지고 있지만 이 문제를 정식으로 제기하기에는 북한이라 는 실체가 존재하기 때문에 현실적인 어려움이 있는 것 또한 사실이다. 그러나 통 일 한국이라는 입장에서 바라보면 이 문제는 전혀 다른 각도로 다가온다. 우리는 간도문제에 대한 역사적 자료 축적과 함께 분명한 입장을 가지고 통일 한국의 미 래에 대비해야 할 것이다.
