The separation of state and religion is not the system for its own purpose but the system to secure the religious freedom more perfectly. Therefore, when the religious freedom collides into the separation of state and religion, it is possible to relax the strict separation. Besides, in modern social state it is required for the state and the church to cooperate each other in the sphere of education and welfare etc.. On the ground of the principle of accommodation, those tests such as Lemon's three prong test, neutrality, indirect aid, divertibility, pervasively sectarian, private choice etc. are the theories that Federal Supreme Court has established to judge the constitutionality of public aid to religion. As a whole, the principle of 'wall of separation' was applied to the public aid to religious private schools strictly until 1980s. But after the 1990s, the Federal Supreme Court has inclined to the conservative attitude prominently, and especially G. Bush government has propelled the public aid policy to the religious organizations comprehensively. Such a comprehensive policy of aid to religion is not desirable in view of excessive entanglement test.

현대의 자유민주국가에서는 종교의 신앙․불신앙으로 인하여 국가로부터 직접 적인 제한이나 차별을 받는 전근대적 종교탄압의 사례는 많지 않고 오히려 종교에 대한 과도한 지원이나 호의적 태도가 정교분리의 원칙과의 관계에서 종종 문제가 되고 있다. 정교분리는 자기목적적인 제도가 아니라 종교의 자유를 완전하게 보장 하기 위한 제도적 보장이고 따라서 양자가 이율배반계로 나타날 때에는 완화해석 의 가능성이 인정될 수 있다. 정교분리의 내재적 한계란 이러한 제도의 목적자체에 서 유래하는 한계이고, 또한 현대의 사회국가에서는 공공서비스를 제공하는 사적 단체와 일정범위에서 상호협력이 필요한 경우도 있다. 다만 지원의 목적, 범위, 방 법, 정도, 사후감독 등에 관한 적절한 규제와 보장장치가 요구된다. 미국의 판례에 서도 이같은 수용의 원리에 의하여 Lemon test, 종파적 중립성, 간접적 원조, 전용가 능성, 광범위한 종교침투성, 개인의 선택 등 다양한 이론이 전개되어 왔다. Lemon 판결의 목적․효과기준은 정교분리와 종교의 자유, 정교분리와 사회국가적 요구와 의 조정원리라고도 할 수 있는데 1980년대이전까지는 비교적 엄격하게 적용되었고 종교계학교에 대한 원조가 합헌으로 인정된 범위는 넓지 않았다. 분리의 벽 완화를 위한 큰 흐름은 있었지만 비교적 합리적인 조화조정이 이루어졌다고 판단된다.
