Woman inmates in the korean correctional facilities can nurse their babies up to 18months after birth by prison governors permission about their child rearing request. But korean correctional nursery system for woman inmates and their babies has basic problems including de-maternity right, non baby friendly nursery in child rearing period, child rearing ideology and so on owing to the its residual, protective, supplementary, bureaucratic character. Therefore, Korean correctional nursery system for woman inmates and their babies has taken cruel state violence character, family punishment. But the existing studies on the korean nursery system in correctional facilities has passed over its unconstitutional, system violence character and so on. Therefore, I asserted my original improvement plan for the proper correctional nursery throughout the interdisciplinary aspect in point of the inherent maternity rights, attachment theory, public care of children, children welfare and so on.

우리나라는 여성수용자가 생후 18개월의 범위의 유아가 있는 경우에는 교도소 에서 그 기간내에서만 키울 수 있는 교도소 양육제도를 실시하고 있다. 그러나 우리나라의 교정양육제도는 후술하듯이 잔여적(residual), 보호적, 보충 적, 관료적 기반에 서 있어 교정양육의 허가기간, 교정양육의 허가권자, 교정양육 의 주체자, 교정양육이념, 교정양육환경, 교정양육 관련 법령에서 아동비친화적이 고 탈모성권적인 근본적인 문제점을 가지고 있다.그 결과 우리나라의 교정양육제 도는 양육자와 유아 및 그 가족에게는 잔인한 족형벌이 되어 왔음에도 선행연구 들에서는 현행 교정양육제도의 위헌적인 제도폭력을 거의 간과하고 있다. 따라서 본 논문에서는 선행연구들의 문제점을 비판하고 난 뒤에 천부인권적 모성권, 아동복지 등 학제적 관점에서 독창적인 개선방안을 제시하였다.
