This article is focused on the U.S.A. Immigration Process and the Removal process. The change of the system related to the Removal process in U.S.A. Immigration laws and the legal process relating to the Removal is the main issue of this article. The general system and the wording and terms related to the Removal will be reviewed and analysed. Further the situations and conditions the foreigner is faced at the process and the related process will be reviewed in altogether. This article is not for the submission for a review by the authorities or any experts in this field but is suggested as an initial guide for the general readers and to help the persons who are going to enter into this field as a first learner.

미국 이민법상의 추방에 대한 제도의 변천을 살펴보고 추방과 관련한 절차에 대해 고찰해보는 기회 를 삼고자 본 논문을 작성하였다. 전반적인 추방제도와 용어에 대해 살펴보고, 외국인이 처한 상황과 배경에 따라 추방절차를 살펴보며, 외국인을 추방할 수 있는 국가에 대해 규정에 따라 고찰해보았다. 보다 구체적으로는, 먼저 추방절차의 개요를 살펴보고, 추방에 대한 개념적 구별을 위해 deportaton, exclusion, removal 등을 상호 비교하였다. 나아가 INA 212조 및 237조의 결과와 추방기간에 대하여 고찰하 였다. 또한 구금, 체포 또는 가석방, 감시 하의 석방, 또는 집행유예 상태에 있는 외국인에 대해서 알아보고, 불법 적으로 재입국하는 외국인에 대한 추방명령의 재집행 및 입국불허사유가 있거나 범죄를 범한 외국인, 그리고 고 용허가 등에 대하여도 정리하였다. 마지막으로는 외국인을 추방할 수 있는 국가의 유형에 대하여 열거하였다. 본 논문은 미국 추방절차에 대해 개괄적인 이해를 돕기 위한 것이며, 학술적 논점의 고찰을 위한 것이 아니다.
