The present study aims at investigating opinions of correctional officers regarding prosecutors’ request for pretrial inmates escort services for their interrogation. There are incompatible practices that law enforcement practitioners from police agencies have to visit correctional facilities and make face-to-face interviews with pretrial inmates for their interrogation, while prosecutors conduct their interrogation and interviews in their own office by utilizing the request of inmates convoy and escort toward correctional agencies in South Korea. This discrepancy between police agency and prosecutor agency aggravate workloads of correctional officers in terms of prosecutors’ demanding requests for inmates escort services. The current study conducted depth interviews toward ten correctional officers for identifying crucial elements and problems of inmates convoy procedures for interrogations of prosecutors. Final five problems were raised by practitioners in terms of correctional fairness, policy efficiency, security and safety, prison overcrowding, and violation against pretrial inmates’ right to defend. Further policy implications will be discussed.

이 연구는 관행적으로 이루어지는 교도관의 검찰 계호, 호송 지원 업무에 대한 교정 실무자들의 의견을 조사하는데 목적이 있다. 최근 교도소 과밀화로 인적, 물적 교정 자원 부족 및 교정 실무자들의 업무 과부화가 점차 심각해지는 상황에서 교도관 실무자들이 느끼는 미결수용자 계호, 호송 업무 지원이 교정 현장에서 어떻게 나타나고 있는지 질적 심층면접 연구로 탐색해 본다는데 연구 의의가 있다. 2015년에 개정된 “UN 수용자 처우에 관한 최저 기준 규칙”을 이론적 바탕으로 하여 미결수용자에 대한 기본적 인권보장과 대등한 방어권 보장을 강조하며 교도관 10명의 의견을 2018년 10월부터 12월까지 3개월에 걸쳐 조사했다. 심층면접 분석 결과, 총 다섯 가지의 실무자 의견을 확인할 수 있었는데 첫째, 수사기관 별(경찰 및 검찰) 업무 협조 형평성 차원에서 검찰만 호송 지원을 한다는 것은 옳지 않다는 점과 둘째, 교정행정의 업무 효율성이 검찰 호송 지원 업무로 인해 떨어지게 된다는 점, 셋째, 일부 수용자의 안전에 큰 위해가 될 수 있다는 점, 넷째, 과밀수용 현상으로 인해 외부 검사 호송 협조 업무가 열악한 교정환경을 더욱 부정적으로 만들 우려가 있다는 점, 다섯째, 검찰 호송 협조 업무로 수용자의 기본권이 과도하게 침해받을 우려가 있다는 점 등이 제기되었다. 교정 실무자들은 형평성에 맞지 않는 과도한 검찰 수사 지원 협조가 최근의 교도소 과밀화 현상과 맞붙으면서 교정 본연의 사회복귀 및 미결수용자 인권 보장 업무에 큰 부담이 되고 있는 것으로 인식하고 있는바, 이에 대한 교정 정책 차원의 새로운 고찰이 필요하다고 본다.
