The purpose of this study is to discuss the correctional meaning of the utilitarian punishment theory of Jeremy Bentham and his Panopticon. According to the utilitarian punishment theory, the purpose of punishment is to enhance social justice through crime prevention. Unlike punishment theory of retribution, which is considered as the deserving price of crime, punishment of utilitarian punishment is gaining persuasiveness in punishment theory and corrections today. Jeremy Bentham, who advocated utilitarian philosophy, presented a punishment theory of utilitarianism based on utility and presented the idea of a Panopticon prison as a way to practice it. The idea of the Panopticon prison has become more popular by Michel Foucault as interpreted by the power of discipline. Foucault saw the Panopticon as a micro-power network that controlled modern societies such as factories, schools, and hospitals. But this interpretation is somewhat distant from the intentions Bentham originally intended to achieve in the Panopticon idea. The purpose of this study is to analyze what Bentham 's utilitarian punishment theory and Panopticon prison idea are based on through his text and to present the correctional meaning of it.

이 연구의 목적은 대표적인 공리주의 철학자인 제레미 벤담의 공리주의 형벌론과 파놉티콘 감옥 아이디어의 교정학적 의미를 규명하는 데 있다. 공리주의 형벌론에 의하면 형벌의 목적은 범 죄예방을 통한 사회적 공리성을 높이는데 있다. 범죄에 대한 응 분의 대가가 형벌의 근거라고 본 응보주의 형벌론과는 달리 공 리주의 형벌론은 오늘날 형벌론과 교정학에서 설득력을 얻고 있 다. 공리주의 철학을 제창했던 제레미 벤담은 공리성을 근거로 공리주의 형벌론을 제시했고 이를 실천할 수 있는 방법으로 파 놉티콘 감옥 아이디어를 제시했다. 파놉티콘 감옥 아이디어는 미 셀 푸코에 의해 규율 권력으로 해석함으로써 더욱 유명해졌다. 푸코는 파놉티콘을 공장, 학교, 병원 등 근대 사회를 통제하는 미시 권력망으로 보았다. 그러나 이 해석은 애초 벤담이 파놉티 콘 아이디어에서 실현하고자 했던 의도와 일부 거리가 있다. 본 연구에서는 벤담의 공리주의 형벌론과 파놉티콘 감옥 아이디어 의 근본 의도가 어떤 것인지를 그의 텍스트를 통해서 분석하고 이에 대한 교정학적 의미를 제시하고자 한다.
