This study aimed to explore the policies on protecting the rights of children with incarcerated parents who have insufficient human rights. Using Delphi a survey, the study was conducted to explore ways to expand the support policies to ensure the rights of children in prison. To do this, we used a specialist Delphi survey to examine the children 's policies on children in Korea and draw up solutions. For the survey, 18 experts from the related fields : correctional, legal, public service, social welfare and academia participated and evaluated the importance of the child support policies and problems. The results of the study were as follows. Experts have recognized that children in prison are being infringed on all four areas and 16 items of child rights : First, the role of government ministries is important for guaranteeing rights of children of incarcerated parents. After evaluating the 'job relevance' and 'effectiveness' of the six government ministries and selecting the necessary projects, the most needed was 'setting up a child friendly family reception room environment'. ; second, It also determined the priorities for the necessary projects among local governments and private institutions. The most needed projects was as a support for living expenses. ; third, to improve the legal system, the government introduced a new law on child support for prisoners and suggested that the department should be decided. Based on these results, the implications and limitations of this study were discussed.

이 연구는 수용자자녀들을 인권 사각지대에 놓인 아동들로 보 고, 수용자자녀들의 권리보장을 위한 지원방안을 모색하는데 목 적을 두었다. 이를 위해 전문가 델파이 조사를 통해 우리나라 수 용자 자녀 정책을 점검하고 지원방안들을 도출하였다. 조사를 위 해 교정, 법률, 공공서비스, 사회복지, 학계 전문가 18명을 선정 하였고, 2차에 걸친 조사에서 수용자자녀 지원정책의 전반적인 사항에 관한 전문가들의 의견을 수렴하였다. 수집된 자료는 질적 및 양적자료가 결합된 자료의 특성상 내용분석 및 계량적 통계 분석을 병행하였다. 연구 결과, 전문가들은 수용자 자녀들이 아동 권리의 4가지 영역 모두에서 침해를 받고 있는 것으로 인식하고 있었으며 16 개의 주된 항목이 도출되었다. 이를 위해 첫째, 수용자 자녀의 권리보장을 위해서는 정부부처의 역할이 중요하다고 의견을 모 았다. 6개 정부부처의 ‘업무 적절성’과 ‘실효성’을 평가한 뒤 필 요한 사업을 선정한 결과 가장 필요한 사업은 ‘아동 친화적 가족 접견실 환경 마련’으로 나타났다. 둘째, 지방자치단체와 민간기관 역할 중 필요한 사업에 대한 시급성과 실효성을 평가한 뒤, 우선순위를 결정하였다. 가장 필요한 사업으로는 생계급여와 양 육비지원으로 나타났다. 셋째, 법제도 개선을 위해 수용자자녀지 원에 대한 법조항을 신설하고, 주무부처를 결정해야 한다는 의견 이 제시되었다. 마지막으로, 연구결과를 토대로 연구의 시사점을 논의하였다.
