Since the launch of the WTO in 1995, trade liberalization has continued to expand. RTA and FTA are steadily increasing, and as a result, the world average tariff rate is gradually declining. In other words, countries that have tried to protect their industries through the means of tariffs in foreign trade have faced many limitations. TBT refers to non-tariff barriers that impede the free movement of trade by utilizing technical regulations, standards, and conformity assessment procedures. However, the criteria for TBT are ambiguous and act as an efficient means of protection trade in accordance with international recognition that technical standards and regulations existing in each country are recognized to some extent. Therefore, if China, the largest trading partner of Korea, can not utilize the tariff barriers, it is expanding the scope of utilizing TBT for the purpose of protecting its industry and the people. Therefore, the purpose of this study is to limit the non - tariff barriers of China to TBT defined by the WTO and to identify the problems of standards, technical regulations and conformity assessment procedures and to suggest related improvement measures.

1995년 WTO가 출범한 이래 무역자유화는 지속적으로 확대되었다. 특히 지역간·국가간 자유무역협정은 꾸준히 증가하고 있으며, 그 결과 세계의 평균 관세율은 점차 하락하고 있다. 대외무역에서 관세라는 수단을 통하여 자국의 산업을 보호하기 위해 노력했던 국가들은 많은 한계에 직면하게 되었으며 이러한 한계를 극복하기 위해 비관세조치를 통하여 자국의 무역을 보호하고 있다. TBT는 대표적인 비관세조치로서 기술규정, 표준, 적합성평가절차를 활용하여 무역의 자유로운 이동을 저해하는 비관세장벽을 말한다. 그런데 TBT에 대한 기준이 모호하고, 국가마다 존재하는 기술관련 표준, 규정 등을 어느 정도의 범위 내에서 인정하는 국제적 인식 때문에 많은 국가에서는 보호무역의 효율적인 수단으로 활용하고 있다. 특히, 한국의 최대 교역국인 중국이 관세라는 장벽을 활용하지 못할 경우 자국의 산업과 자국민의 보호라는 목적아래 TBT를 적극 활용할 여지가 확대되고 있다. 따라서 본 연구는 중국의 비관세장벽을 WTO에서 규정한 TBT로 한정하여 표준, 기술규정, 적합성평가절차에 대한 문제점을 파악하고 관련 개선방안을 제시하는 것을 목적으로 한다.
