Amended Korea-US FTA, CPTPP and USMCA, which have significant meanings to Korea's trade policy, have been entered into force or ratified. In the midst of an abrupt change in the investment policy by the U.S., it is of importance to understand recent trends of FTA investment chapters and its policy implications on Korea's accession to the CPTPP by analyzing the investment chapters of amended Korea-US FTA, CPTPP and USMCA. In order to properly implement the analysis, this paper reviews them as followed. First, in order to review the accession to the CPTPP, this paper examines the present state of investment between Korea and members of CPTPP and, based on the examination, makes a comparison between Korea's major investment destinations'(Japan, Viet Nam, Singapore and Australia) previous investment rules with Korea and CPTPP investment rules. Second, this paper analyses the investment chapters of Korea-US FTA, CPTPP and USMCA to review the possible invocation of the MFN clause of Korea-US FTA upon the Korea's accession to the CPTPP.

최근 한-미 FTA 개정의정서 발효, CPTPP 발효, USMCA 개정협상 타결 등 한국 통상정책에 있어 중요한 의미를 갖는 FTA들이 타결 또는 발효되었다. 보호무역주의에 기반한 미국 통상정책 하에서 미국의 투자정책 기조에도 큰 변화가 감지되는 가운데, 최근 개정 또는 발효된 한-미 FTA, CPTPP, USMCA 투자챕터를 분석하여 주요 FTA 투자챕터 동향을 파악하고, 한국의 CPTPP 가입여부 결정에 있어 정책적 함의를 도출할 필요가 있다. 이에 이 논문은 다음과 같이 검토를 진행하였다. 첫째, 한국과 CPTPP 회원국간의 투자현황을 분석하였으며, 이를 토대로 한국의 주요 투자대상국인 일본, 베트남, 싱가포르, 호주 등과 기체결한 FTA 및 BIT 투자규범과 CPTPP 투자규범을 비교․분석하였다. 둘째, CPTPP 가입에 따른 한-미 FTA 투자챕터 최혜국대우 조항 원용가능성을 검토하기 위해 한-미 FTA 투자챕터 개정사항과 개정사항外 차이점을 비교․분석하였다.
