This article is intended to survey the basic contents of the Taiwan Bankruptcy Act(hereafter the Act), which was enacted in 1935 during the period of the Republic of China and is still in force in Taiwan. The Act has been revised several times ever since, and is characterized by the fact that the Act is a basic law in the bankruptcy case, and it regulates both composition(Chapter 2) and bankruptcy(Chapter 3) in a single act. In the light of the fact that there is no introduction at all in Korea so far, we have described the Act in general, such as the brief history, the basic principle and its structure of the act, etc. In this paper, we have first explained the concept of bankruptcy, the characteristics of the bankruptcy system, the structure and public purpose of legislation of this act, one by one, and last but not the least, the basic principle of the Act. In Taiwan, several drafts amendment to the Bankruptcy Act have recently been presented since 2004 in order to make fundamental changes, including the possible modification of the act name from the bankruptcy act into the Debt Clearance Act. A further study on the related subject matter on the basis of this survey will give us some meaningful suggestions de lege ferenda and will also provide useful implications for interpretation of our bankruptcy law through comparative legal research.

이 글은 1935년 제정되어 현재 대만에서 시행되고 있는 대만 파산법 에 대한 기본내용을 국내에 소개하기 위한 것이다. 대만 파산법은 수차 례의 개정을 거쳐 현재 파산에 관한 기본법으로 대만 파산법은 화의와 파산을 같이 규정하고 있는 점에서 특징이 있다. 국내에 소개가 없는 점을 고려하여 대만의 파산법의 간단한 연혁과 기본원리와 편별체계 등의 일반론을 차례로 서술하였다. 본 논문에서는 먼저 대만 파산법이 말하는 파산의 개념을 설명하고 파산제도의 특징과 현행 파산법의 편별체계와 제정과 개정경과를 차례로 설명하였다. 특히 파산법의 제정이유를 공식적 자료를 가지고 설명하였다. 마지막으로는 파산법의 기본원칙을 설명하였다. 최근 대만에서는 최근 파산법의 명칭까지도 채무정리법으로 바꾸는 개정안 등이 나와서 여러 모로 변화를 꾀하고 있다. 향후 이러한 대만 파산법의 일반론을 통하여 세부주제에 대한 심화연구를 하면 향후 우리 도산법에도 입법론이나 비교법적인 시사점을 줄 수 있을 것이다.
