A company is liable for its products. This product liability is specified in the Product Liability(PL) Act. PL is an essential factors in surviving company. Therefore, there are increasingly many company that are enforcing the PL to ask the responsibility for the supply of the safe products. It was investigated the level of the perception and response level of the small and medium companies regarding the PL in order to derive desirable and successive measurements. It was researched and analyzed the company's acknowledgment, necessity, influence, countermeasure of PL by using the questionnaire. The results was described as follows as. The degree of companies' perception of PL were high but companies' countermeasure ability were not high comparison with companies in the early days of PL implementation. The small and medium companies didn't become a dominant-subordinate relationship with large companies. They should cope with PL by themselves. In the case of small and medium companies, the financial and working conditions are inferior, the authorities should consider the difficulties encountered by companies and enlarge financial support.

법률적 제도의 엄격화 요구의 충족은 기업생존의 필수요건으로 자리를 잡고 있는 실정에서 149기업을 대상으로 PL에 관한 설문조사를 실시하여 중소기업들이 어느 정도 대응하고 있으며 적절한 대응을 위해서는 어떤 보완책이 필요한가를 파악코자 하였다. 설문지의 내용은 PL의 인지도, 필요성, 영향 평가. 대응방안 등 4범주로 구성하였다. 설문결과, 대부분의 중소기업들은 PL 시행은 알고 있지만 인적, 재정적 한계 때문에 PL 대책수립은 미흡하고 정부의 지원도 PL 시행 초창기와 비교하여 큰 진전 이 없는 것으로 파악되었다. 따라서 기업의 입장에서는 먼저, PL 대응전략이 자생력을 갖는 것이 필요하다. 대기업과의 종속관 계라는 제약에서 탈피하여 상생 동반자 관계를 유지하려는 의식하에 PL 대응전략을 수립하여야 할 것이다. 그리고 정부의 입장 에서는 중소기업에 대한 인적, 물적, 재정적 지원정책에 대한 적극적 홍보와 더불어 중소기업의 영세성을 고려하여 우선적으로 재정적 지원의 범위가 확대 실시되어야 할 것이다.
