In July 2014, the Constitutional Court ruled that the Constitution was not in conformity with the provision that only those who are registered as resident registration in Article 14 of the National Voting Act or who are domestic residents are supposed to vote. This is because the suffrage of 2.4 million overseas Koreans is excluded. At that time, the Constitutional Court requested the amendment legislation by December 31, 2015, and if it is not revised by this time, the referendum law clause will be ineffective from January 1, 2016. However, three years have passed since July 2014, when the Constitutional Court ruled, but the law has not yet been amended. In early 2018, the National Election Commission revised the National People’s Voting Act as a new variable in the discussion of the constitutional amendment, with the interpretation that the National Election Commission should revise the National Voting Act in order to hold an amendment vote in the 6.13 local elections. The NEC said it would not be able to make an electoral list for overseas Koreans unless the National People’s Voting Act was amended, so it could not hold a constitutional referendum. Therefore, if the referendum law is left unchanged, it will deprive the 2.4 million overseas Koreans of their suffrage and neglect the laws and regulations. In the 20th National Assembly, the members of the Liberal Democratic Party, including the independent member Lee Yong-ho, the free Korean party lawmaker Ham Jin-kyu, Kim Do-eup, and the Democratic Party lawmaker Lee Wonok and Shim Jae-kwon, The free Korean government, which promised to hold a local election and a constitutional referendum in June as a pledge of the last presidential election, is now responding passively, arguing that it is important to discuss the constitutional amendments such as the structure and timing of power. The Constitution, which was amended in 1987, may be revised at any time, but the National Voting Act, which has been judged to be unconstitutional, should be revised. This is a serious reason for violating the Constitution and the law, ignoring the people as a duties that forget the original duties of lawmakers who have to legislate. Through this paper, I would like to consider the amendment of the National Voting Act, which has been ruled out of 2.4 million overseas Koreans and has been judged to be inconsistent with the Constitution. I would like to compare the history of the referendum law with the pending legislation in the National Assembly and look for ways to revise it. 2014년 7월 헌법재판소는 국민투표법 제14조 1항 주민등록이 되어 있거나 국내 거소 가 되어있는 사람만 투표하기로 되어있는 조항에 대해 헌법불합치 결정을 내렸다. 이는 240만명 규모의 재외국민의 참정권이 배제되기 때문이다. 당시 헌법재판소는 2015년 12 월 31일 까지 개선입법을 요청했고 이때까지 개정하지 않으면 2016년 1월 1일부터 국민 투표법 조항은 효력을 잃는다고 밝혔다. 그러나 헌법재판소에서 판결한 2014년 7월 이후 3년이 지났으나 아직까지 법령개정이 되지 않고 있다. 2018년 초 중앙선거관리위원회가 6.13 지방선거 때 개헌투표를 실시하기 위해서는 국민투표법을 먼저 고쳐야 한다는 유권해석으로 국민투표법 개정이 개헌 논의의 새로운 변수로 부상 했었다. 선관위는 국민투표법이 개정되지 않으면 재외국민투표용 선거인명 부 작성이 불가능하여 개헌 국민투표를 실시할 수 없다고 말했다. 따라서 국민투표법을 그대로 둔다면 240만명에 달하는 재외국민들의 참정권을 박탈하고 법령을 방치하는 것이 된다. 20대 국회에서 무소속 이용호 의원을 비롯하여 자유한국당 함진규 의원, 김도읍의원, 더불어 민주당 이원욱 의원, 심재권의원등이 국민투표법 일부개정 법률안을 발의 했다. 지난 대선 공약으로 6월 지방선거와 개헌 국민투표를 동시에 실시한다는 공약을 내놓은 자유한국당은 이제 와서 개헌은 권력구조와 시기 등의 개헌내용논의가 중요한 본질이라 며 부수법안에 해당하는 내용을 두고 먼저 해결해야 한다는 주장을 하며 소극적으로 대응 하고 있다. 1987년에 개정된 헌법이 언제 개정될지 모르지만 헌법불합치 판정을 받은 국민투표법 이 개정되어야 한다. 이것은 입법을 해야 하는 국회의원들의 본연의 임무를 망각한 직무 유기로서 국민을 무시하며 헌법과 법률을 위반한 중대한 사유가 된다. 이 논문을 통해 재 외국민 240만명을 배제하여 헌법불합치 판정을 받은 국민투표법 개정 방안을 고찰해 보 고자 한다. 국민투표법의 역사와 국회에 계류중인 법률안을 비교해 보고 개정방안을 모색 해보고자 한다.
