This article reviews legal issues of Braggs v. EAA, Texas Supreme Court’s decision in 2016. This decision had analyzed the specific standards in reviewing the economic values of lands when the government performs regulatory taking after the Penn Central decision. According to the court, the economic impact is regarded as a deciding factor, and the compensation should consider current market value and expected value of lands. The case had occurred arguments because the court held that the 2.5 million dollar as compensation including unused lands for a long time. The Texas supreme court held economic values more importantly than other factors, while holdings before the case had put more importance on the balancing test between the factors suggested by the Penn Central case. However, criticisms arise under the fact that the court had expanded the relation between the regulation and the benefit, which make the predictability of damages lower. From this case, we may be reconsider economic value more importantly than other factors while balancing the current and the future economic value of the land.

본고는 2016년 텍사스주 대법원에서 판단한 Braggs v. EAA 판단을 연구 의 대상으로 삼았다. 특히 본 판결은 Penn Central 판결 이후 규제적 수용이 이루어질 경우 토지의 경제성에 대한 구체적 평가기준에 관심을 가졌다. 판 결의 내용에 따르면 보상금액 산정에 있어서 경제적 영향은 당연히 중요한 영향을 미치며, 금액 산정 시 현존 시장가격 뿐만 아니라 토지의 기대이익의 변동도 고려하여야 한다. 다만, 현존 시장가격 산정에서 시장가격 뿐만 아니 라 장기간 미사용하였던 토지의 보상금액도 모두 반영하여야 한다고 판단하 여 약 2.5백만달러의 보상금액이 확정되어서 논란이 되었다. 대상판결은 연방대법원이 그간 Penn Central 판결에서 제안한 네 가지 기 준 중 이익형량을 강조하던 기존의 판단과 달리 경제적 효용평가에 더욱 적 극적으로 판단하였다는 점에서 의미를 갖는다. 특히 수자원 이용 허가권 거 래제가 시행됨에 따라 허가권의 경제적 효용까지 고려하였다. 하지만 기대이 익에 대한 배상판결은 규제와 이익 사이의 인과관계를 지나치게 확대하여, 이로 인하여 발생하는 손해에 대한 예측가능성이 낮게 인정된다는 점에서 비 판을 받는다. 우리나라의 경우에도 토지보상의 유형과 내용이 풍부하게 논의되고 있으나 본 사례를 통하여 재산권의 애초 사용가치와 현재의 사용가치에 대한 균형적 고려가 더욱 요구된다는 점을 생각할 수 있다.
