In this paper, I propose the validity of the rationale for independence of wrestling rights, focusing on the aspect of broadcasting freedom, which is the formation of democratic basic order. And the freedom of broadcasting as a means of positive liberty that contributes to the formation of rational public sphere and the democratic system to work. The purpose of this study is to clarify the grounds of the collective rights of the employees by judicial interpretation. The purpose of this study is to clarify why the positive liberty of maintaining and developing the democratic basic order of broadcasting is superior to the subjective public authority of the broadcasting company and to demonstrate that the right of the right of organization is shared and internal freedoms should be expanded in order to r ealiz e such f reedom. And that t he l egally mandatory i ndependence of t he right to freedom of expression is in the scope of legislative formation, not excessive violation of freedom of broadcasting and independence.

이 연구는 민주적 기본질서의 형성이라는 방송 자유의 측면을 중심으로 편성권 독 립에 대한 논리적 근거의 타당성을 제시하고자 하였다. 방송권은 사업자의 권리가 아 니라 국민의 방송주권을 이행하는 공조물로 해석하였다. 그리하여 공정한 정보와 관점 을 전달함으로써 합리적 공론장을 형성하고 민주적 체제가 작동되도록 기여하는 적극 적 자유의 의미로서 방송 자유를 논하였다. 방송주권을 위임받은 방송평성권은 주체가 사업자만의 경영권에 귀속되는 것이 아니라 종사자들의 집합적 권리인 근거를 법리적 해석으로 규명하려하였다. 또한 사업자의 주관적 공권보다 왜 방송의 민주적 기본질서 유지와 발전이라는 적극적 자유가 더 우월한지를 밝히고 그러한 자유를 구현하기 위하 여 편성권의 주체가 공유되는 권리이며 내적 자유가 신장되어야 함을 논증하고자 하였 다. 편성권 독립의 법적 의무화가 방송의 자유와 독립에 대한 과도한 침해가 아니라 입법형성의 범위에 있다고 해석하였다.
