Korean custody system for criminals with mental illness has based on politic, social populism based on authoritative political culture, conservative judicial exclusive regime, sensational commercial journalism, populism policy due to the man psychology of the masses who has been brainwashed by punitive symbolism and Bacon’s theatrical idol. Therefore korean custody system for criminals with mental illness has included diverse, basic problems became of its social security character, residual therapeutic jurisprudence. Diverse existing studies about its problems has mainly approached in legal and administrative aspect and overlooked anti-human aspect and anti-judicial psychiatry aspect which has been secretely hidden in Korean custody system for criminals with mental illness. Therefore, I showed desirable device about it in ideological, human, therapeutic jurisprudence, social welfare aspect which existing studies have overlooked. In conclusion, I asserted that distorted symbolism which has been deeply hidden in custody system which has emphasized on social security under the influence of political populism.

정신장애범죄인에 대한 보안처분으로서의 치료감호제도는 순수한 사법정신의 학과 교정복지 및 인본주의적 관점에서 전개되어온 서구와 달리 우리나라에서는 권위주의적 정치문화와 보수적인 사법독점레짐, 선정적인 상업적 저널리즘과 응 보주의적 상징과 베이컨의 극장의 우상에 세뇌되어 온 대중들의 집단심리에 기 인한 정치사회학적인 포퓨리즘적 형사정책에 기반해 왔다. 따라서 치료감호제도 는 사회방위적 성격과 잔여적(residual)치료적사법의 성격이 강해 다양하면서도 근본적 문제점이 있어왔다. 이러한 치료감호제도의 문제점에 대하여 다양한 선행 연구들은 주로 치료감호제도의 법적, 행정적 측면에서 접근해와 치료감호제에 깊 이 은밀히 숨겨져 있는 반 인권적 요소와 반(反)사법정신의학적 요소 등을 간과 해 왔다. 따라서 본 논문에서는 선행연구들이 간과한 치료감호제의 이념적, 인권적, 치료적사법, 사회복지적 측면에서의 개선방안을 제시하였다. 결론적으로 포퓨리즘 적 정치사회적 자원을 배경으로 보안을 강조해온 치료감호제도에 깊이 숨겨진 왜곡된 상징을 해체할 것을 주장하였다.
