Recently, the Korean government has considered modifying the list of over-the-counter (OTC) drugs to increase consumer welfare. Considering the institutional intent ‘to improve public access to medication’, adjustments to the list of OTC drugs would be needed, but safety must first be ensured to enhance consumer benefits. As a result of comparative legal analysis for other countries, institutional enhancement or legal amendment on three things would be needed as follows. First, the classification criteria should be specified in the law and ingredients and types of drugs need to be presented considering formulations. Second, precursory regulations on consumer-oriented labeling is strictly required so that consumers can choose safe medicines. Third, the side effect reporting system should be activated and linked to the reclassification system so that the list of OTC drugs can include only safe medicines.

최근 정부는 소비자 편익을 증대시키기 위하여 안전상비의약품 품목의 조정을 논의하고 있다. ‘의약 품에 대한 국민의 접근성 향상’이라는 제도적 취지를 고려할 때, 품목 수의 조정은 필요하다고 생각 한다. 그러나 소비자 편익을 확대하려면 우선 안전성이 담보되어야할 것이다. 약국 외 의약품 판매를 허용하고 있는 다른 국가들과 비교 검토해본 결과, 세 가지에 관한 제도적 보완 내지 법 개정이 필요하다고 생각한다. 첫째, 분류기준을 법에 명시하고 제형 등을 고려하여 성분 및 구체적인 품목을 제시하는 체계로 변경해야 한다. 둘째, 소비자가 안전한 의약품을 선택할 수 있도록 소비자 중심의 표시기재에 대한 엄격한 사전규제가 필요하다. 셋째, 의약품의 부작용보고 체계를 활성화시켜야 한 다. 그리고 이를 재분류 체계와 연관시켜 안전성이 확보된 의약품을 바탕으로 품목 조정이 이루어질 수 있도록 하여야 한다.
