On 29th, December, 2015, the National Assembly revised the ACT ON ACQUISITION OF AND COMPENSATION FOR LAND, ETC. FOR PUBLIC WORKS PROJECTS, and let it go through hearing opinions from Central Land Tribunal about Projects Deemed Project Approval, in which right of eminent domain was granted before the approval. Accordingly, Central Land Tribunal established ‘criteria for public interests’ based on the research services of Korea Public Land Law Association. And based on this standard, it conducted a public interest review on 1,030 Projects Deemed Project Approvals from 30th June, 2016 to 31th December, 2016. This paper explains the background and contents of establishing ‘criteria for public interests’ established by Central Land Tribunal, reviews the legal issues related to the reviewing process of public interests, and discusses ways to improve the effectiveness of the reviewing process of public interests.

지난 2015년 12월 29일 국회는 ｢공익사업을 위한 토지 등의 취득 및 보 상에 관한 법률｣을 개정하여, 개별법상 인허가에 따라 토지수용권이 부여되 는 이른바 ‘사업인정 의제사업’에 대하여 인허가 전에 중앙토지수용위원회로 부터 사전에 의견청취절차를 거치도록 하였다. 이에 따라 중앙토지수용위원회는 한국토지공법학회의 연구용역을 참고하여 ‘공익성 판단기준’을 수립하였고, 이 기준을 기초로 2016년 6월 30일부터 같 은 해 12월 31까지 1,030건의 사업인정 의제사업에 대한 공익성 검토를 수 행하였다. 본 논문은 중앙토지수용위원회가 수립한 ‘공익성 판단기준’의 수립배경과 내용을 설명하고, 공익성 검토절차와 관련된 법적 쟁점을 검토하였으며, 공익 성 검토절차의 실효성을 높이기 위한 방안을 다루고 있다.
