There is usually a residual land in relation to the presence of roads and railways. Different from the past, when it comes to the construction like above, recently, many civil complaints are filed such as closing entrance ramp and violating the right to enjoy sunshine due to the enclosed‐type structure construction in which the soils are piled up by many meters. As a result, there is a huge increase in the number of procedures for the redemption of procedural rights. Currently, there are buying residual land, depreciated compensation, construction expenses indemnification, etc. as the procedures of the right redemption. But the procedure above are complicated or difficult to undergo in the process of proceeding, apart from the procedures of admission process. Also there are lack of coherence and passive side for redemption of right in the arraign and level of recognition, because there is no specific criteria for the purchase, depreciation and construction cost As shown above, the procedure of the redemption of right for the residual land is seperately divided, and also complicated in its usage. Moreover, there are not enough applicable standards. Therefore, this dissertation addresses the operational problems of the redemption of right for the residual land and its difficulties by examining the multisteps of compensations and suggests a feasible plan

도로 및 철도 등의 선사업과 관련하여 주로 잔여지가 발생한다. 과거와 달 리 최근에는 위와 같은 사업을 위한 공사시 수미터에서 수십미터까지의 높이 로 성토를 하여 폐쇄형 구조물 공사를 하게 되면서 잔여지에 진입로 폐쇄, 일조 내지 조망 침해 등 민원의 소지가 많이 발생하게 된다. 그 결과로 잔여 지 상의 권리구제를 위한 이의절차가 크게 증가하는 추세이다. 현재 위와 같은 잔여지상의 권리구제절차로 잔여지 매수, 잔여지 감가 보 상, 잔여지 공사비 보상 등이 존재하고 있으나, 위 절차들은 편입부분에 대한 이의절차와는 별개로 재결절차를 거쳐야 하는 절차상의 복잡함 내지 어려움 이 있다. 또한, 그 매수, 가치하락, 공사비에 대한 구체적인 기준이 마련되어 있지 않아 권리구제절차에서 그 인정여부 및 인정정도에 있어 일관성이 없거 나 권리구제에 있어 소극적인 측면이 있다. 본 논문은 위와 같이 잔여지 권리구제절차가 별개로 나뉘어져 그 활용에 있어 복잡하고, 그 구체적인 적용기준이 마련되지 않아서 실무상 발생하는 권리구제측면의 어려움을 보상의 여러단계별로 나누어 살펴보고 그에 대한 대안을 제시하고 있다.
