The expropriation and compensation system in Korea was started in 1962 through the legislation of Land Expropriation Act. And it is generally accepted that the expropriation and compensation system has been one of the most important factors to enable the great economic development in Korea. On the other hand, sometimes it is criticized that the expropriation and compensation system in korea has treated the efficient implementation of public works more importantly than the appropriate protection of property rights. Especially, the consideration of project approval which deems a certain permission or licence by the other laws as a project approval by Land Compensation Act, makes public works obscure and protection of property rights insufficient. For this reason, the amendment of Land Compensation Act(2015) stipulates the limitation of public works and the hearing the opinions of the Central Land Tribunal in the case of the consideration of project approval. The purpose of this thesis is to examine the amendment of Land Compensation Act and to find out the future issues that can pursuit both the efficient implementation of public works and the appropriate protection of property rights equally.

우리나라의 수용보상제도는 1962년 ｢토지수용법｣의 제정으로 도입되어 지 난 50여 년간의 고도성장의 밑거름이 되었다는 것은 주지의 사실이다. 그러 나 이러한 과정에서 우리나라의 수용보상제도는 공익사업의 효율적인 추진과 국민의 재산권 보장이라고 하는 두 가지의 목표 중 지나치게 공익사업의 효 율적인 추진에 경도되어 왔다는 지적을 받기도 하였다. 특히 개별법에서의 사업인정 의제를 광범위하게 인정함으로써 공익사업의 범위가 불명확하게 되 고, 이로 인해 국민의 재산권이 제대로 보장되지 않는다는 문제점이 꾸준히 제기되어 왔다. 이에 2015.12.29 ｢공익사업을 위한 토지 등의 취득 및 보상 에 관한 법률｣을 일부 개정하여, 공익사업의 범위를 한정하고 개별법에 의한 사업인정 의제 시에는 중앙토지수용위원회의 의견을 듣도록 하였다. 본 논문은 개정 ｢공익사업을 위한 토지 등의 취득 및 보상에 관한 법률｣의 내용과 향후의 과제를 살펴봄으로써 공익사업을 효율적으로 추진하면서도 국 민의 재산권 보장에 보다 충실할 수 있는 방안을 모색하는데 그 목적이 있다.
