In this paper, we will write about the Constitutional Regulations on the Agricultural Economy in Chapter 9 of the Constitution. It is necessary to write an article about the agricultural economy while looking at the regulations on the whole economy, but we will focus on Articles 121 and 123 of the Constitution in order to concentrate the discussion. The proposed amendment of the Constitution is to maintain Article 121 of the Constitution. Today, there is no complete disappearance of half-feudal tenant farming system, the emergence of smart farm agriculture as a new agricultural form, respect for the Constitutional meaning of Article 121 of the Constitution which follows the current Constitution, considering socio-economic reasons such as the speculative demand cut-off for agricultural land, Article 121 of the Constitution shall be upheld. In addition, Article 123 (1) of the Constitution shall be replaced with Article 123 (1) of the Constitution of the Constitutional Amendment Advisory Committee Report of January 2018, and maintained the provisions of Article 123 (2) through (5) of the Constitution. Considering the importance of academic research, agricultural claims, public opinion, and the Article 123 (1) of the Constitution, which emphasizes the public interest function of agriculture and rural areas, is necessary.

본 논문에서는 헌법 중에서 제9장 경제 분야에서 농업경제에 관한 헌법규정을 중심으로 글을 쓰고자 한다. 전체적인 경제에 관한 규정을 살피면서 농업경제에 관한 글을 써야 하지만 논의의 집중을 위하여 헌법 제121조 및 제123조를 중심으로 살펴본다. 필자가 제안하는 헌법개정안은 헌법 제121조를 그대로 유지하는 것이다. 오늘날도 반봉건적 소작제가 완전히 없어진 것은 아니란 점, 새로운 농업형태인 스마트팜 농업의 등장, 현행헌법까지 이어 온 헌법 제121조에 대한 헌법사적 의미를 존중한다는 점, 농지에 대한 투기적 수요 차단 등의 사회경제적 이유를 고려하여, 헌법 제121조를 존치시키는 데 찬성한다. 또한 헌법 제123조 제①항을 2018년 1월 국회헌법개정특별위원회 자문위원회 보고서의 개정안 헌법 제123조 제①항으로 대체하는 것이다. 그리고 나머지 헌법 제123조 제②항부터 제⑤항까지는 그대로 유지시키는 것이다. 학계의 연구, 농업계의 주장, 국민의 여론, 헌법에서 차지하는 농업의 중요성을 고려하여, 농업과 농촌의 공익적 기능을 강조하는 개정안 헌법 제123조 제①항은 필요하다고 본다.
