Even though The policy for persons with mental illness shifted from hospital care to community rehabilitation and integration after the revison of The Mental Health Act to The Mental Health and Welfare Act 2017 in Korea, the inclusion of persons with mental illness in community have been disturbed by continuing disqualifying legal provision based on mental illness. Advanced research is very rare and has not accomplished concrete draft for revision of laws which have disqualifying legal provision based on mental illness. This research found that most of disqualifying legal provisions based on mental illness do not have any justifiable reason and are against the principles for limitation of human rights in Korean Constitution Law. It also try to examine legitimacy and validity of the disqualifying legal provisions and make an alternative proposal for its abolition, in which authorities would order person with mental illness to stop the duty for reason of disease or problems on the body and mind and the person can raise objection to the duty-stop order.

2017년 정신건강복지법의 시행 이래 정신질환자에 대한 정책이 입원치료 중심에서 지역사회로의 복귀와 통합으로 전환되었음에도 불구하고 정신질환자를 각종 사회 경제활동의 참여에서 배지하는 결격조항이 유지되고 있어서 정신질환자의 사회통합을 가로막고 있다. 정신질환자의 결격조항에 대하여 선행 연구는 희소하고 구체적인 입법방안을 제시하는 데에는 이르지 못하였다. 이에 본고에서는 정신질환자를 일률적으로 특정 자격이나 사무에서 배제하는 결격조항이 그 입법목적의 정당성이 인정되는 경우가 매우 제한적일 뿐 아니라 기본권제한의 과잉금지 원칙에 위배되어 위헌의 소지가 있음을 밝혔다. 그리고 결격조항을 절대적 결격조항, 상대적 결격조항, 처분심사형 조항으로 분류하여 그 타당성을 검토하고 일본의 최근 결격조항 정비 동향을 참고하여 장애를 구체적으로 열거하지 않은 방식으로 질병 기타 심신상의 사유로 인하여 특정 사무에 종사하는 것이 부적합하다고 인정되는 경우에는 개별 심사를 통하여 직무 중지를 명하고 당사자가 이를 다툴 수 있는 절차적 권리를 보장하는 방안을 결격조항 폐지의 대안으로 제시하였다.
