The fear of fine dust perceived by Koreans, in recent years, has been found to pose a serious threat to daily life and health and due to the seriousness of particulate matter originating from China, this problem is no longer a personal issue but international one requiring cooperation of Chinese and Korean governments. China has rapidly emerged as one of G2 countries due to rapid economic growth fueled by policy of reform and opening, and has become the world's largest greenhouse gas emitter since 2007, surpassing the US. This is because of the fact that the Chinese government had focused on rapid economic growth and ignored environmental problems. The particulate matter has become a serious social problem in China as well as Korea, and in particular, the dust wind from desert in China and the harmful particulate matter from the industrial area have interacted with the abnormal atmospheric phenomena caused by global warming, becoming more extreme problems. Accordingly, with the purpose of solving the environmental problems faced by China and meeting the global standard as a response to environmental pollutant and climate change, the Chinese government has set up a national plan for improving the air environment and responding to climate change in earnest since 2007 and was preparing legislation that supports such efforts. Specifically, the Chinese government has emphasized continuously the importance of green and climate technology development. Chinese government, during the 12th Five Year Plan period, emphasized sustainable economic and social development through energy conservation and low-carbon technology development and, during the 13th Five Year Plan period, promoted the special plan about science and technology innovation for improvement of atmospheric environment and response to climate change. China's environmental pollution control technology has been developed continuously with the support from various policy by Chinese government, and China's policy to strengthen air pollution control may be a risk factor in one hand and an opportunity in other hand for Korean companies to export to China. It is indispensable, therefore, to study the Chinese legislation on promotion of atmospheric and environmental technology This study is expected to contribute not only academically to the field of Chinese legislation for solution of particulate matter but also practically to provide legal basis for Korean companies in environment industry to enter Chinese market as a new opportunity. In addition, It is considered that both Korean and Chinese governments should continue to strengthen and develop cooperation measures to improve the particulate matter atmospheric environment.

최근 몇 년간 우리나라 국민들이 체감하는 미세먼지에 대한 공포는 일상생활과 건강에 심각한 위협을 주는 것으로 밝혀졌으며 중국발 미세먼지의 심각성으로 인해 이 문제는 더 이상 개인의 문제가 아닌 중국과 한국이 함께 해결해야 할 중대한 국제적 관심사가 되었다. 중국은 개혁개방으로 인한 급속한 경제성장에 따라 G2 국으로 급부상하였고 2007년을 기점으로 미국을 제치고 세계최대의 온실가스 배출국이 되었다. 이는 그동안 급격한 경제성장에만 초점을 두고 환경문제는 뒤로 미룬 결과에 기인한 것이라 할 수 있다. 미세먼지는 한국 뿐만 아니라 중국에서도 심각한 사회문제로 떠올랐으며 특히 중국 사막의 모래바람과 공장지대의 유해성 미세먼지는 지구온난화로 인한 대기이상 현상과 상호작용하여 더욱 극단적인 문제로 대두 되었다. 이에 중국 정부는 중국이 직면한 환경문제를 해결하고 세계적인 환경오염물질 감축 및 기후변화 대응에 부합하기 위해 2007년부터 본격적으로 대기환경 개선 및 기후변화 대응을 위한 국가방안을 수립하고 관련 연계 정책과 이를 뒷받침하는 법제들을 마련하고 있다. 이를 구체적으로 살펴보면 중국정부는 녹색·기후기술 개발에 대한 중요성을 지속적으로 강조하였으며 12.5 규획기간에는 에너지 절약 및 저탄소 기술개발을 통한 지속가능한 경제사회발전을 강조해 왔고 13.5 규획기간 동안은 대기환경 개선 및 기후변화대응을 위한 과학기술혁신 전문계획이 본격적으로 추진되었다. 중국의 환경오염 대응 기술은 중국정부의 다양한 정책적 지원에 힘입어 나날이 발전하고 있으며 중국의 대기오염 관리 강화 정책은 우리 기업들의 중국 수출에 위험요소이자 한편으로는 기회가 될 수 있다. 따라서 중국의 대기환경기술개발 촉진사업에 관한 법제 연구는 필수불가결 하며 본 연구는 미세먼지 해결을 위한 중국의 관련 법제 연구라는 학문적 성과뿐만 아니라 실무적으로 환경 관련 우리 기업들에게 중국 시장이 새로운 기회가 될 수 있도록 법적 근거를 마련해 주는 역할을 할 것으로 기대된다. 아울러 한 중 양국은 미세먼지 및 대기환경 개선을 위한 협력 방안을 지속적으로 강화하고 발전시켜 나가야 할 것이다.
