This study summarized the rights and fundamental rights of the hearing impaired to sign language and education. The key word of this paper is that the law about the protection of the right to be educated by standardized sign language of the hearing impaired person is implied. First, the Constitution stipulates the right to receive equal education according to the ability of all citizens. People with hearing impairments should also be guaranteed the right to an equal education based on their potential. Second, the language of the hearing impaired is sign language and oral language. In current law, sign language is not recognized as a language. Since sign language was not recognized as a language, sign language standardization was not done. Third, in order to realize the right to receive education for the hearing impaired, sign language must be recognized as a language so that sign language standardization can be achieved. In addition, it provides systematic education with standardized sign language, promotes the development of sign language, and provides the opportunity to live a dignified life as a human being, a core ideology pursued by the right to education, and a worthy life. It should be possible.

본 연구는 청각장애인의 수화 그리고 교육을 받을 권리와 기본권에 대해 요약했다. 이 논문의 핵심키워드는 ‘청각장애인의 표준화된 수화로 교육을 받을 권리’의 보장성에 대한 법리가 내포되어 있다. 첫째, 헌법의 기본권으로 모든 국민은 국가로부터 능력에 따라 평등히 교육을 받을 권리를 규정하고 있다. 청각장애인도 잠재능력에 따라 평등하게 교육을 받을 권리를 보장 받아야 한다. 둘째, 청각장애인의 언어는 수화와 구화이다. 현행법상 수화는 언어로써 인정되고 있지 않다. 셋째, 청각장애인의 기본적인 교육을 받을 권리를 실천하기 위해서는 표준화된 수화를 언어로써 인정되어야 이를 통해 수화표준화가 이루어 질 수 있다. 또한 수화가 표준화로 체계적인 교육을 제공하고, 표준화된 수화의 발달로 발전하여 교육을 받을 기회가 추구하는 핵심적인 이념으로 인간으로써의 존엄과 가치있는 삶의 기회를 마련하고, 더 나아가 자유로운 인격발전을 가능하게 해야 하는 것이다.
