The Brazilian labor law, enacted in 1943, strongly emphasized the pro-labor character that “workers should be protected because they are socially weak.” However, the labor law of Brazil in 2017 has changed very much. With so much content being amended, the most noteworthy point is that before and after the amendment the basic premise of the law has changed. After the amendment, the Brazilian labor law can be regarded as turning from a pro-labor character to a business-friendly one. From a theoretical point of view, the labor law elements that seem to be rigid has been considerably flexible, so that it can be seen that the state interventionism has largely retreated and the civil law perspective has been dominant. This change in the Brazilian labor law will be one of the processes to overcome many difficulties called the Brazil Cost and enter the advanced countries. However, in light of the political upheaval and economic instability, it is worth noting that this change in the Brazilian Labor Law would lead to some positive results in the future.

1943년 제정된 브라질 노동법은 ‘근로자는 사회적 약자이므로 배려하고 보호해야 한다’는 친노동자적 성격을 강하게 드러내고 있었다. 그렇지만 2017년브라질 노동법은 매우 크게 변화하였다. 너무나 많은 내용들이 개정된 가운데, 가장 주목할 점은 개정 전과 개정 후가 법의 기본적인 전제가 달라진 모습을보인다는 점이다. 개정 후 브라질 노동법은 친노동자적 성격이 퇴색되고 친기업적(business-friendly)인 방향으로 선회했다고 평가할 수 있다. 이론적 관점에서는 국가간섭주의(intervencionismo estatal)가 대폭 후퇴하고 사법(direito privado)적 관점이 우위에 섰다고 보아도 좋을 만큼 경직적으로 보일 만한 노동법적 요소들이 상당히 유연화되었다. 브라질 노동법의 이런 변화는 종래 브라질 코스트(brazil cost)로 불리는 여러가지 어려운 점을 극복하고 선진국으로 진입하고자 하는 과정의 하나일 것이다. 다만 정치적 격변과 경제적 불안정 속에서 브라질 노동법상 이러한 변화가 향후 어느 정도의 긍정적인 결과로 이어질지 귀추가 주목된다.
