This paper aims to approach the thought of the wartime period and the structure of the postwar politics in Japan by analyzing the historical significance of a controversy between Minobe Tatukichi and Yokota Kisaburo. 　　Three points will be demonstrated throughout my analysis. (1) The idea of the “Greater East Asian Co-Prosperity Sphere” was supported by the theories of Minobe and Yokota. It was not intended result of Minobe and Yokota. Nevertheless, their theories paradoxically gave hints toward the thought in the wartime period. (2) After defeat, the ideas of Minobe and Yokota, as influenced by Georg Jellinek and Hans Kelsen, functioned as justification for the U.S.-Japan Security Treaty system. Tanaka Kotaro affirmed the system as the Director General of the Supreme Court. In the background was Minobe's theory. (3) In the context of the history of constitutional amendment, internationalism functioned as an opportunity to invite completion of the sovereignty. Therefore, internationalism may not contribute to the principle of international peace.

본고에서는 미노베 다쓰키치(美濃部達吉)(헌법학)와 요코타 기사부로(横田喜三郎) (국제법학)의 논쟁의 사정(射程)을 명확히 하고자 한 것으로, 전시기(戦時期) 일본의 사상과 전후 정치의 구조에 접근하고자 하였다. 본고의 분석을 통하여 다음을 명확 히 하였다. (1) 대동아공영권(大東亜共栄圏) 사상이 미노베(美濃部)와 요코타(横田)의 학설에 의해 지지 받았던 점. 그것은 양측이 의도한 결과가 아니었지만, 역설적으로 2명의 이론(理論)이 전시사상(戦時思想)에 힌트를 준 점. (2) 패전 후에 옐리네크와 켈젠에 영향을 받았고 미노베와 요코타의 지성(知性)이 전후에 있어 미일안보체제 (日米安保体制)를 정당화하는 논리가 되었던 점. (3) 헌법개정사의 문맥에 있어서 국 제주의를 성립시키는 계기로서 기능한 점. 그 때문에 국제주의와 국제평화주의를 보 장할 수 없는 가능성이 있는 점.
