The purpose of this study was to investigate the derivation processes and the results for the land parcel boundary for a mutual agreement between landowners to suggest the definitive plan that can effectively induce their mutual agreements in the Cadastral Resurvey. The plans to effectively induce a mutual agreement between landowners for the land parcel boundary suggested in this research are summarized as follow: First, to prepare a criterion for establishment of boundary on the ground, the processes and the detail contents to ensure adjusted boundary that is decided in a committee determining the true boundary are suggested although the examples of establishment of boundary defined in a special law and a regulation for current cadastral resurvey exist. Second, it is proposed that a plan to reorganize that the functions and the roles of committees for the cadastral resurvey of a city, a district, and a borough and for decision of boundary, which are defined in a special law for current cadastral resurvey, are combined each other rather than that they are compatible. Moreover, a solution for overcoming the limit in human resources is presented, and contents which can adjust loop holes in the current law related to committee are suggested. Finally, as a plan to enforce the conciliation system as a practical way that is to solve a conflict of interests and to induce a mutual agreement between landowners for the land parcel boundary, it is suggested to adopt the conciliation-prepositive principle in the range of obvious conciliation objects via the establishment of democratic legitimacy and the elimination of the side effect of conciliation system in the cadastral resurvey process.

본 연구는 지적재조사사업에 따른 지적재조사측량과정에서 토지소유자간 합의경계를 유도하기 위한 방안을 모색하였다. 지적재조사측량에 따른 경계확정의 실태를 조사ㆍ분석하고, 이를 통해 문제점을 도출하며, 도출된 문제점을 효율적으로 해결할 수 있는 방안으로서 토지소유자의 합의경계가 원만히 유도될 수 있는 방안을 요약하면 다음과 같다. 첫째, 지상경계 설정기준의 마련과 관련해서는, 현행 지적재조사에 관한 특별법 및 지적재조사측량규정에서 규정하고 있는 경계설정의 예시와는 별도로, 진실경계 본위에서 합의된 조정경계가 확정될 수 있는 프로세스와 그 구체적인 내용을 제시하였다. 둘째, 현행 지적재조사에 관한 특별법으로 규정하고 있는 시ㆍ군ㆍ구지적재조사위원회와 경계결정위원회를 양립하여 설치ㆍ운영하는 것보다는 시ㆍ군ㆍ구지적재조사위원회에서 경계결정위원회의 기능 및 역할이 포괄될 수 있는 부분으로 개편하는 방안과 위원회 구성의 인적 제약을 극복하기 위한 방안을 제시하였고 위원회와 관련된 현행법상의 미비점을 보완할 수 있는 내용을 제언하였다. 마지막으로, 토지소유자 간의 경계에 관한 이해다툼을 해소하고 원만한 합의경계를 유도하기 위한 실질적 수단으로서의 조정제도를 강화하는 방안으로서, 지적재조사측량과정에서의 민주적 정당성의 확보 및 조정제도의 역기능을 차단함으로써 명확한 조정대상의 범위 내에서 사실상의 조정전치주의를 채택하는 방안을 제시하였다.
