This study attempts to discuss legislative and institutional support for the development of Korean ODA-related industries. In so doing, existing and proposed ODA-related laws are analyzed, and institutional improvements in the legislature are proposed. The analysis shows that most existing laws are not well designed to promote the involvement of companies into ODA-related industries. In addition, governmental agencies of ODA and private sectors are not well connected even though the relationship between two has been emphasized. Currently, the development of ODA-related industries seems to be challenging due to the segmentation among ODA agencies, lack of educational systems of ODA experts, and heavy industry centered legislative systems. Therefore, it is essential to develop specific legislations for the development of ODA-related industries through systemic development of laws and establishment of legislative terms.

본 연구는 국내 ODA 산업 육성 및 발전을 위한 법적, 제도적 지원책 마련을 논의하였다. 이를 위해 국내 ODA 산업에 관련된 존재하는 법안과 제출된 법안들을 분석하였고 입법부 내 제도 개선점도 모색하였다. 분석 결과, 대부분의 기존 법률안들이 실질적인 산업 분야별 ODA 참여 확대를 가능하게 할 수 있는 방안에 대한 규정이 부재한 것이 드러났다. 또한 해외 시장 진출의 확대 방안을 모색하고 협력 국가와의 연계 강화를 강조함에도 불구하고 ODA를 전담하여 수행하는 기관과의 협업 체계가 구축되어 있지 않았다. 이와 같이 현재 한국의 ODA는 전담 부처의 분절화, 실질적인 ODA 전문 인력 양성 체제 미확립, 중공업 중심의 법적 지원체제 등의 문제로 인하여 국내 ODA 산업 육성 및 발전에 어려움을 겪고 있다. 따라서 ODA 산업 개념의 법체계화 및 법률상 동일 용어의 확립 등을 통하여 국내 ODA 산업 육성 및 발전을 위한 세부적인 입법안 수립에 대한 논의가 활성화되어야 할 것이다.
