The event on how to renew about the expiring of the right to use 20 years of residential construction land in WENZHOU, caused social attention again and it has made the discussion on the renewal system become a hot spot of academic research. Aimed at the recent event of the expiring of the right to use residential construction land in WENZHOU, and combined with the similar event in QINGDAO, SHENZHEN, analyzes the current law of renewal system of the right to use construction land in China. Present Chinese laws only simply stipulates when the expiration date is arriving, the using rights of Residential construction land will renew itself, the law has not made any rules about whether the renewal is for free or not, as well as the procedures, conditions, the times of renewal and the ownership of the house, still lack of Maneuverability. The implication is not distinct enough. Ending the situation with shortage of legal system when we deal with these problems. This leads to some social contradictions. Therefore, how to improve our law system quickly and settle the problems that may occur after the expiration date of Residential construction land’s using rights have a vital meaning. The Chinese Property Law provides: residential construction land use right expiration of the period, the automatic renewal, which is of great significance for the protection of the common people’s housing rights and interests. But they will find that there are still many problems when the provision comes to use, such as the scope of the automatic renewal, the renewal belongs to gratuitous renewal of bargained renewal, the premise of the renewal, how many times and how long it can renew, etc. In order to solve the conflict between the duration of the use right of the residential construction land and the permanent ownership of the house, it is necessary to supplement and perfect the relevant provisions of the implementation of the system of automatic renewal of the right to use land for housing construction. This paper mainly analyzes the possible issues in the implementation process of the automatic renewal of the right to use land.

최근 중국 원저우(温州)에서 발생한 20년 기한의 주택 건설용지사용권이 만료된 사 건이 사회적 관심을 일으키면서 건설용지사용권의 연장제도에 대한 관련 학계의 연구 가 활발해지게 된다. 최근 원저우에서 발생한 주택용지 기한만료 사건과 함께 칭다오, 션전에서 발생한 유사 건설용지 기한만료사건을 살펴보고, 중국 건설용지사용권 연장 제도와 관련한 현행 법률규정 및 그 문제점을 살펴보고자 한다. 중국 현행 법률은 주택 건설용지사용권의 기한 만료 이후 자동연장에 대하여 매우 간단하게 규정하고 있다. 즉, 기한만료 이후 연장에 대해 연장의 유무상 여부, 연장 절차, 조건, 기한, 횟수, 비용 및 지상 건축물의 귀속문제에 대해 명확하게 규정하고 있지 않다. 이로 인하여 해당 문제의 구체적 처리 방안이 마련되지 않아 기한 만료에 따른 분쟁이 발생하게 되면서 조속히 명확한 법적 근거를 마련할 것이 요구되고 있다. 중국 ≪물권법≫ 제149조는 “주택건설용지사용권은 기한만료 이후 자동연장한다” 라고 규정하였다. 해당 조문은 사람들의 주택권익을 보호한다는 측면에서 매우 중요한 가치가 있다. 또한 사람들이 70년의 토지사용권 기한이 만료된 이후를 고민할 필요 없이 부동산은 국가에 무상으로 회수 당하는 것이다. 본 조문 규정에 따라 주택의 소유 인은 연장신청을 하지않고 토지사용기한의 자동연장의 권리를 향유할 수 있고, 국가는 입법을 통해 그 재산권을 보장하였다. 하지만 해당 규정을 실시하는 과정에서 몇 가지 문제가 존재하였고, 그 예로 자동연장의 적용범위에 대해 연장시 대가를 지불하여야 하는지 여부, 토지출양계약의 재체결 필요성 여부 등을 명확히 규정하지 않았다. 중국 공민들은 70년의 주택토지사용권의 기한이 만료된 이후, 주택이 여전히 자신의 재산에 속하는 여부에 대해 여전히 의문을 가진다. 실제 중국 주택건설용지사용권 한시성 및 주택 소유권의 영구성간의 충돌을 해결하고, 이와 동시에 공민의 거주권을 보장하기 위하여 주택건설용지 사용권의 기한문제와 관련하여 그 실시세칙을 보완하여야 한다. 본고는 주로 주택건설용지사용권의 기한제도를 살펴보고 실시과정 중 존재하는 문제 점을 살펴보고자 한다.

温州20年住宅建设用地使用权到期该如何续期的事件,再度引发社会高度关注,对建设 用地使用权续期制度的相关探讨成为学界研究的热点。针对近期温州发生的住宅用地到 期事件,并结合青岛、深圳发生的同类建设用地到期事件,阐析中国建设用地使用权续期 制度的现行法律规定。中国现行法律只是简单的规定了住宅建设用地使用权期限届满后 自动续期，对于续期是否有偿、续期的程序、条件、期限、次数、费用以及地上房屋的 归属问题规定不够明确，缺乏可操作性。实践中具体处理此类问题时无法可依，从而引 发一系列社会矛盾。尽快完善法律，解决住宅建设用地使用权期限届满后可能出现的问 题具有重要的现实意义。 中国《物权法》中规定了“住宅建设用地使用权到期后自动续期”。该条规定对保护 人们的住宅权益有着重大价值,使得人们不用顾虑在70年的土地使用权期满后,房产将会 被国家无偿收回。按照此条规定,房屋所有人可以拥有不提出续期申请而享受自动延长 土地使用期限的权利,国家在立法上保障了其财产权。但是这一规定在具体实施中可能 存在一些问题,例如对于自动续期的适用范围,续期时是否应该支付对价,是否要签订土地 出让合同以及续期的前提、次数及期限等具体操作问题未作明确规定。人们对于70年的 住宅土地使用权到期后,房屋是否还属于自己仍然存在疑虑。为了从实际上破解中国住 宅建设用地使用权期限性和房屋所有权永久性之间的冲突,同时保障人们的居住权利,因 此有必要对自动续期制度实施的相关细则进行补充完善。本文主要就住宅建设用地使用 权自动续期制度在实施过程中存在的不足进行分析。
