Recently, in Japan, the bill for the full amendment of the Civil Code(law of obligations) passed through the National Assembly and passed into law (June 2, 2017). In this article, I surveyed the contents of the amendment and the purpose of the legislation mainly on extinctive prescription, or statute of limitation. Under the reformed Japanese Civil Act, the extinctive prescription of the following rights shall become complete if not exercised for a period of 10 yeard(Articles 162 through 165). Moreover the short period was all deleted for the simplication of this system. And it introduced the new contents, as follows: for example, the interruption and suspention of prescription, the dual starting point of subjective and objective standard, and etc. This revision resembles the draft of Korean Civil Code(2014). So we think that the amendment of the general provisions of Japanese Civil Code has a lot of contents that can be referenced in interpretation and legislation of the Korean civil law in the future.

2017년 일본에서 민법(채권법)이 전면개정되었다. 본고에서는일본 민법(채권법)의 개정사항 중 민법총칙의 소멸시효를 중심으로 개정내용과 입법취지를 개관해 보았다. 소멸시효는 시효기간 동안 그 권리를 행사하지 않는 상태가 계속되어 권리를 소멸시키는 것이다. 이러한 민법의 시효에 대하여 일본민법은 시효의 통일화를 위하여 단기시효기간의 폐지, 시효의 중단과 정지사유의 재정리, 객관적, 주관적 기산점으로의 2원화와 같은 새로운 내용으로 개정되고 있다. 이러한 개정은 2014년 우리 민법개정안과 같은 태도로 시효에 관한 한 양국은 국제화와 통일화에 맞추어 방향을 같이하고 있다고 할 수 있다. 이외에도 새로운 비교법적 동향을 반영하고 종래의 민법에서 문제되던 여러 제도를 정비하고 있다. 향후 우리 법에 많은 시사점을 줄 것으로 생각된다. 민법의 시효에 대하여 일본민법은 시효의 통일화를 위하여 단기시효기간의 폐지, 시효의 중단과 정지사유의 재정리, 객관적, 주관적 기산점에 의한 2원화와 같은 새로운 내용으로 개정되고 있다. 이러한 개정은 2014년 우리 민법개정안과 같은 태도로 시효에 관한 한 양국은 국제화와 통일화에 맞추어 방향을 같이하고 있다고 할 수 있다. 이외에도 새로운 비교법적 동향을 반영하고 종래의 민법에서 문제되던 여러 제도를 정비하고 있다. 향후 우리 법에 많은 시사점을 줄 것으로 생각된다.
