The main characteristic of the Japanese criminal law revision is the tendency to “criminalisation” to punish acts that were not previously criminal, and the trend to punish them with more severe penalties. The revision of the criminal law related to sex crimes related to the revision of the sex crime process and the revision of the sex crimes related to the sex crime process, which is called for severe punishment of sex crimes, and the abolition of statute of statute of statute of statute of limitations, are far ahead of Japan. In addition, through our comparative review of gender-related legislation, we will draw suggestions for the readjustment of areas where legislation is still insufficient and where there are complementary issues.

최근 일본 형법 개정의 주요 특징은 종래에는 범죄시 되지 않았던 행위를 처벌 대상으로 하는 ‘범죄화’ 경향, 종래부터 처벌되어 온 행위에 대해 더욱 중한 형벌로 처벌하려는 ‘중벌화’ 추세, 처벌의 ‘조기화’ 등을 통한 형사입법의 활성화 혹은 최초수단화로 요약할 수 있다. 이 중 범죄화 및 중벌화 경향과 관련한 성범죄 관련 형법개정 즉, 성범죄 엄벌 화와 공소시효 폐지 및 기간 연장은 우리의 형사입법이 상당부분 일본에 앞서가고 있다고 할 수 있으나, 최근 Me Too 운동의 확산과 성범죄에 대한 인식제고와 함께 엄벌화가 요구되고 있는 만큼 본 연구에 서 일본에서의 성범죄의 엄벌화 추진 과정 논의와 주요 개정내용 및 관련 판례를 살펴보고 시사 를 얻고자 한다. 또한 우리의 성범죄관련 입법과 비교검토를 통해 여전히 입법 미비 및 보완의 문제가 있는 부분의 재정비를 위한 제언을 이끌어내고자 한다.
