In recent years, the definition of child abuse has transcended a definition in the narrow sense, which is accompanied by physical injuries, and made use of a concept in the wider sense, which encompasses emotional abuse and neglect as well. Nevertheless, actual measures regarding or interventions in child abuse have been limited solely to physical and sexual abuse. Therefore, this study analyzed 25 criminal rulings to determine what the judicial judgment was on emotional abuse and neglect. The results of the study are as follow. Emotional abuse was often denied if it was a combination of physical and sexual abuse and emotional abuse. In addition, regarding domestic violence that had been witnessed, judgments acknowledging emotional abuse likewise were in the minority only. As for the acknowledgment of neglect, opinions differed according to the court, thus failing to exhibit consistency. In terms of such findings, the study discussed issues including why the crime of emotional abuse must be acknowledged as a crime of co-occurrent abuse and why domestic violence that had been witnessed must be acknowledged as emotional abuse and proposed issues including the responsibilities of justice and social welfare concerning emotional abuse and neglect.

최근 아동학대에 대한 정의는 신체적 외상이 있는 협의의 정의를 넘어 정서학대와 방임까지 포함하는 광의의 개념으로 확대하여 사용하고 있다. 그럼에도 불구하고 아동학대에 대한 실제적 조치나 개입에 있어서는 대부분 신체·성학대에 대한 것으로만 한정하고 있다. 따라서 본 연구는 정서학대와 방임이 발생한 사건에 대한 사법적 판단이 어떠한지를 분석하였다. 연구의 자료는 아동복지법 제17조(금지행위) 위반으로 처벌받은 1심 형사판결문 중 정서학대와 방임의 범죄사실이 기재된 25개를 대상으로 하였으며, 질적 내용분석 방법을 사용하였다. 연구 결과는 다음과 같다. 신체·성학대와 정서학대가 중복하여 발생한 경우 정서학대가 다른 유형의 학대로 포섭되는 것으로 보고 정서학대죄를 인정하지 않는 판례를 따르고 있는 경우가 많았고, 가정폭력 목격을 정서학대로 인정하는 판례도 아직 확립되지 않았다. 방임죄에 대해서도 재판부마다 인정 여부가 엇갈렸다. 이러한 연구 결과에 따라 정서학대죄가 단일의 학대죄로서 인정되어야 하는 점과 가정폭력 목격이 정서학대로서 인정되어야 하는 점 등을 논의하였으며, 정서학대와 방임죄에 대한 사법과 사회복지 영역에서의 책임 등을 제언하였다.
