Antitrust compliance program (CP) was first introduced in 2001 to promote compliance culture among business enterprises. However, the focus of later development was placed on the adequacy of the mitigation of administrative fines based on the introduction of CP, away from its original objectives. Thus the mitigation of administrative fines based on CP was finally abolished in 2016, severely harming the incentives of business enterprises for CP. Moreover, there have been little development of proactive measures to promote CP, and nowadays only a small number of companies are applying for the grade evaluation of CP. In order to reverse the downward trend and facilitate the compliance culture among business enterprises, we need to take the two-fold measures as follows. First, the grade evaluation standards and procedures should be improved to better discriminate between paper compliance and effective compliance, so as to reintroduce the mitigation of administrative fines based on CP. Second, proactive measures, such as education, consulting and financial assistance, need to be taken to promote CP among business enterprises.

공정거래 자율준수 프로그램(CP)은 자율적인 법 준수 문화를 조장하고자 2001년 처음 도입되었다. 그러나 이러한 당초의 취지와는 달리 그 후의 제도 변천 과정에서는 주로 CP 운영기업에 대한 과징금 감경이 적절한가 하는 문제에 초점이 맞추어지면서, 자율준수 프로그램의 운영을 근거로 한 제재 감경의 부당성만 강조되고, 자율적 법 준수 문화의 확산을 통해 법 위반행위를 사전에 예방한다는 CP 본래의 취지는 몰각되고 말았다. 그 결과 CP 제도의 확산을 위한 정부의 지원정책은 거의 개발되지 않는 상태에서, 자율준수 프로그램 운영기업에 대한 과징금 감경 혜택만 2008년부터 단계적으로 축소된 끝에 2016년 완전히 폐지되었으며, 최근에는 CP 등급평가를 신청하는 기업의 숫자마저 급격히 감소되어 이제는 CP 제도의 존립 자체가 불확실한 상황에 이르렀다. 이러한 왜곡된 결과를 해소하기 위해서는 다음 두 방향의 개선책이 필요하다. 첫째, CP의 실효성 여부를 보다 잘 판단할 수 있도록 CP 등급평가기준과 방법을 개선하고, 모범적인 CP 운영에 대한 사후적 유인으로서의 과징금 경감을 부활시킨다. 둘째, 과징금 감경이라는 양날의 칼에만 의존하는 현행 제도의 틀을 넘어 기업들이 실효성 있는 CP를 도입⋅운영할 수 있도록 돕기 위한 다각도의 지원정책을 실시하며, 준법감시인⋅준법지원인 등 유사제도와의 시너지를 추구한다.
