This study is for suggesting concrete countermeasure by analyzing cases and facts about secondary damages of dating crimes through mass media, previous studies and statistics while the recent secondary damages of dating crimes are recognizable. After researching facts and cases about the secondary damages of dating crimes, there are classified as three different ways. First one is the secondary damages of second conviction. Second one is secondary damages which are made by law enforcement. Third one is secondary damages which are caused by criminal trials’ outcomes. Based on the problems of these cases, if law enforcement provides the countermeasures of secondary damages, First of all the public needs to change in understanding of dating crimes and the law enforcement should actively participate in dating crimes. Second, we must improve the dating crimes act. Especially, we have to prepare the Stalking Prevention Act and bring ‘the Claire Law’ from england and change it appropriate for Korean society to prevent dating crimes. Through this law, we have to process data on arrest and criminal histories in advance. Third, we have to organically react to dating crimes cases by helping other related departments from the start of receiving the case and construct cooperative public order system to prevent the secondary damages.

본 연구에서는 최근 데이트폭력의 2차 피해에 대한 심각성을 인식하여 언론매체와 선행연 구, 통계자료 등을 조사하여 데이트폭력 2차 피해의 실태와 사례를 분석하여 구체적인 대응방안 을 제시하고자 하였다. 데이트폭력의 2차 피해에 대한 실태와 사례를 분석한 결과 데이트폭력의 2차 피해는 크게 가 해자의 재범에 의해 발생되어진 2차 피해, 수사기관과 형사사법기관의 대처와 처리과정 중에서 발생되는 2차 피해 그리고 형사재판결과에 대한 2차 피해로 발생된다. 이러한 사건사례의 문제점 을 바탕으로 다음과 같은 2차 피해 방지대책을 마련하면 첫째, 데이트폭력에 대한 범죄로의 인식 전환과 수사기관의 적극적인 대처가 필요하다. 둘째, 데이트폭력에 대한 현행 법제도의 정비와 개 선이 필요하다. 특히 스토킹과 같은 데이트폭력을 예방하기 위해 스토킹행위방지법을 마련하고 영국의 ‘클레어법 제정을 우리 실정에 맞게 도입하여 사전에 상대방의 전과 정보 등을 조회할 수 있게 해야 한다. 셋째, 데이트폭력에 대한 사건 접수 단계부터 관련 부서 간 협업을 통해 유기적 으로 대응하고 2차 피해를 방지하는 치안협력체제를 구축해야 한다.
