This article discusses the need to revisit the concept of State-sovereignty in the context of the ongoing construction of new international order. In order to do so, it takes the example of the European Union. This problem is not restricted only to the areas of constitutional and international laws, but extends to that of philosophy of law. For we can observe a conceptual shift in this repect from posivitism to Kantian constructive approach. For philosophical survey, this article starts with a sort of criticism of Austinian concept and theory of sovereignty, which seems to be obsolete when we take changes of international order into consideration. Then, this article continues with Kantian constructive approach, which seems to be plausible when applied to the question of possibility of constitutionalism in pluralist polities like the European Union. We will also see that this approach is recently taken by positivists like Neil MacCormick and Jeremy Waldron, who are conscious of the weakness of the traditional positivism in this question. To conclude, this article will show that the future of the European Union as conceived by Kantian cosmopolitanism is based on the theory of relational sovereignty.

본고는 탈냉전시기에 새롭게 형성되고 있는 국제질서의 맥락에서 기존의 국가주권의 개념에 대한 재고찰이 필요함을 유럽연합의 경우를 예로 들어 고찰한다. 이 문제는 단지 헌법이나 국제법의 영역에만 국한되는 것이 아니라 더 깊게는 법철학적 인식의 변화에 대한 고찰을 바탕으로 하지 않으면 안 되는 정치철학의 문제이기도 하다. 이를 위해 본고는 먼저 오스틴 이후의 실증주의적 주권 개념과 이론으로써는 현재 변화하는 국제질서에서의 주권의 문제를 적절히 설명할 수 없는 한계가 있음을 지적한다. 그 다음으로는 실증주의적 주권 개념을 극복할 수 있는 법이론 또는 법철학으로서 칸트의 주권 이론 및 세계시민사상을 간략히 소개한다. 신칸트주의가 취하고 있는 구성주의적 규범론은 유럽연합과 같은 다원적 정체(政體) 내에서의 입헌주의의 가능성을 설명하는 데 매우 유용하고 적절함을 보게 된다. 그리고 이와 같은 구성주의적 접근은 다른 한편으로 최근 수정적 실증주의에서도 채택되어 전통적 실증주의의 한계를 극복하고자 하는 시도가 있음도 본다. 결론적으로 칸트적 세계시민주의를 이념으로 하는 견해가 제시하는 유럽연합의 미래는 상관주의적 주권론을 기반으로 하고 있음을 보게 될 것이다.
