2017년 독일민법 개정에 따른 새로운 여행법과 소비자보호

New travel law and consumer protection under the Revision of German Civil Law in 2017

Currently, the Civil Code has only eight articles on travel contracts, and there is only a general clause stipulating minimum protection for planning trips. Although consumer dispute rates are currently the highest for package tours, other travel disputes are also steadily increasing. Therefore, there is a limit to the protection of the traveler by the present Civil Law travel contract. On the other hand, the German Civil Code has already established a travel contract as a prestigious name to contribute to the protection of the travelers from the end of the 1970s, thus it provides a high level of protection for travelers as a consumer. However, due to the domestic legalization requirements of the European Union Directive (EU package travel Directive 2015/2302, hereinafter "Directive") for planning trips and travel travels on November 25, 2015 and new disputes derived from various forms of travel. The contents of the German Civil Code can provide a theoretical basis for the legislative adjustment in the future. The Directive seeks to harmonize the level of consumer protection in package travel and linked travel arrangement. The German Travel Law was amended to incorporate these guidelines into national legislation and it provided a fairly concrete definition of the rights and duties of travel sponsors as well as travelers covered (travel providers and travel brokers). Since Germany provided a particularly high level of consumer protection in Europe, the level of consumer protection is not necessarily enhanced by the domestic legalization of the Directive. There are also issues such as the removal of holiday homes and day trips that have been recognized for more than 30 years from package travel, and the possibility for travel organizers to increase the price up to 8% after making travel reservations. However, it is meaningful that the amendment clarify the protection of consumers by securing transparency and legal certainty of package travel.

현재 우리 민법에서는 여행계약과 관련한 조문은 8개에 불과하며, 기획여행에 대한 최소한의 보호만을 규정한 일반조항이 마련되어 있을 뿐이다. 현재 기획여행에 대한 소비자분쟁 비율이 가장 높긴 하지만, 그 외 다양한 여행분쟁 역시 꾸준히 증가하고 있다. 따라서 현재 민법 여행계약 조문으로 여행자를 보호하기에는 한계가 있다. 이에 반해 독일 민법에서는 이미 1970년 대 말부터 여행자 보호에 기여하고자 여행계약을 명문으로 규정하여 특히 소비자로서의 여행자를 위한 높은 수준의 보호장치를 마련하였다. 그러나 2015년 11월 25일 기획여행 및 연계여행급부 유럽연합지침(EU 기획여행지침 2015/2302, 이하 “지침”)의 국내법화 요구 및 다양한 여행형태로부터 파생된 새로운 분쟁 등으로 독일 여행법은 새로운 국면을 맞이하게 되었다. 지침과 개정 독일민법의 내용은 향후 우리 법개정에 이론적 기초를 제공할 수 있다. 따라서 새로운 여행법의 운용이 독일 소비자 및 사업자에게 어떠한 영향을 가져올지 주목해 봐야 할 것이다. 지침은 기획여행 및 연계여행급부계약에 있어서 소비자보호수준을 완전하게 조화시키고자 한다. 독일 여행법은 이러한 지침의 국내법전환으로 개정이 이루어졌으며, 보호대상인 여행자뿐만 아니라 여행주최자 등(연계여행급부 제공자 및 여행중개자)의 권리의무에 대하여 상당히 구체적으로 규정하였다. 독일은 유럽에서도 특히 높은 수준의 소비자보호를 제공하였기 때문에, 지침의 국내법화로 인하여 소비자보호수준이 강화된 것만은 아니다. 30년 넘게 인정되어 온 휴가주택과 당일여행에 대한 보호가 기획여행에서 삭제되고, 여행주최자에게 여행예약 후 8%까지 대금증액을 할 수 있는 가능성을 부여하는 등의 문제 등도 제기되고 있다. 그러나 개정을 통하여 기획여행의 투명성과 법적 확실성을 확보하여 소비자보호를 더욱 명확히 하였다는 점에서 큰 의미가 있다. 또한 특히 그 동안 논란이 되었던 연계여행급부 개념을 규정하고 연계여행급부 제공자에게 여행주최자와 동일한 의무를 부과하는 등 연계계약급부와 관련해서는 전반적으로 여행자를 더욱 보호할 수 있게 되었다.
