The purpose of this study is to diagnose the problems related to the weapon system R&D project and to propose the improvement method suitable for the characteristics of the weapon system R&D project. In this study, we focused on the issues related to the contract deposit in relation to the difference of the progress payments system applied between the national contract law and the weapons system R&D project. Through this study, it is aimed that concrete and efficient improvement measures related to the contract deposit are drawn and reflected in the contract about the project applying the established system considering the characteristics and the relativity of the weapon system R&D project. These improvements can reduce the financial burden on contractors and guarantee the development conditions. In addition to being able to meet the target performance and delivery period of the ordering organization, it is possible to prevent post-dispute by the regulations set by the contracting parties at the time of contracting for specific matters, and contribute to stable research and development.

본 연구의 목적은 기성제도가 적용된 무기체계 연구개발 사업에 관한 문제점을 진단하고, 무기체계 연구개발의 특성에 맞는 개선방안을 제안하는 것이다. 본 연구에서는 일반적으로 국가계약법령을 적용한 기성제도와 무기체계 연구개발 사업에 적용된 기성제도의 차이점 중에서 계약보증금과 관련된 사항을 중심으로 살펴보았다. 본 연구를 통해 무기체계 연구개발의 특성과 환경을 고려하여 기성제도를 적용한 사업에 관해 구체적이고 효율적인 계약보증금 관련 개선방안을 도출하여 계약에 반영할 수 있도록 하고자 한다. 본 연구의 개선방안은 계약상대자의 재정적 부담 경감과 개발여건을 보장해 줄 수 있고, 발주기관의 목표성능과 전력화시기를 충족할 수 있음은 물론 구체적인 사안에 대하여 계약체결 당시에 계약당사자간 정해놓은 규정에 의해 사후 분쟁을 미연에 방지할 수 있어 안정적인 계약관리와 연구개발에 기여할 수 있을 것이다.
