Administrative action is defined as the total act of the executive, excluding legislative and judicial acts, as an active and active state action to realize the concrete realization of the purpose of the state and the interests of the whole society members through the regulation of the law. The sanctions that are imposed against the violation of the administrative regulations and the means by which the administrative agency is selected to achieve the administrative purpose are done in various ways. The purpose of this study is to investigate the relationship between the investigation of the special judicial police and the administrative investigation, and the distinction between the investigation as the judicial act and the administrative investigation as the preparation and auxiliary means for the future administration, . The purpose of this study is to examine the nature and the concept of Special Judicial Police affairs, the theoretical background of investigations and administrative investigations, the procedural justice through the simultaneous application of administrative action and judicial action in Special Judicial Police investigation process, I would like to make a prospective, forward- looking proposal by referring to the boundaries of investigation and administration that conflict in the operating organization.

행정(administration)은 법의 규제를 통해 국가 목적의 구체적인 실현과 사회구 성원 전체의 이익을 실현하기 위해 행하는 능동적이고 적극적인 국가 작용으로 입법 작용과 사법작용을 제외한 행정부가 실시하는 작용의 전체라 정의된다. 행정기관은 이와 같은 행정목적 달성을 위해 채용되는 수단과 행정법규 위반에 대하여 가해지는 제재는 다양한 방법으로 이루어지고 있다. 본 논문은 특별사법경찰의 수사와 행정조사의 관계에 있어 사법 원리 작동에 의한 사법행위인 수사와 장래의 행정작용을 위한 준비적·보조적 수단으로서의 사실행위인 행정조사와의 구분이 특별사법경찰의 수사에 대해 미치는 영향에 대한 논의를 중심으로 하였다. 이와 같은 논의의 결론에 접근하기 위하여 본 논문의 구성은 특별사법경찰사무의 본질과 개념, 수사와 행정조사의 이론적 배경, 특별사법경찰 수사과정에서 행정작 용과 사법작용의 동시적용에 따른 절차적 공정성 검토와 이를 통해 특별사법경찰제 도를 운영하는 조직에서 갈등하고 있는 수사와 행정의 경계를 언급하여 발전적인 미 래지향적 제언을 하고자 한다.
