Since the formation of the concept of multicultural education it has included elements of human rights education, such as civics education. In the early days of multicultural education in Korea, the focus was on understanding multicultural families and supporting migrants, reflecting increased immigration to Korea. Multicultural education continues to focus on this original concept, but has expanded to incorporate education to prevent bias and discrimination against immigrants, and encourage Korean students and citizens to be magnanimous in the face of growing multiculturalism in their society. Multicultural education in Korea is therefore similar to multicultural human rights education. This study critically examines the features and extent of multicultural education pursuant to applicable legislation and ordinances(regulation) and points out the limitations. In order to invigorate multicultural human rights education, the following require modification: shifting from a multicultural understanding-focused education to multicultural human rights education, requiring human rights education for people who work in multicultural contexts, and providing human rights education for immigrants and immigrant youth. In addition, this study suggests the enactment of a Multicultural Education Support Act, which would invigorate multicultural human rights education.

다문화교육은 개념이 형성되는 과정에서부터 민주시민교육으로서 인권교육적 요소들을 내포하고 있었다. 한국에 다문화교육이 도입된 초기에는 이주민이 증가하던 시기였기 때문에 다문화가족에 대한 이해와 이주민 지원에 초점이 있었다. 현재는 다문화교육이 본래의 개념을 추구하며 모든 시민과 학생 들의 문화 다양성에 대한 포용과 이주민에 대한 편견과 차별을 예방할 수 있는 교육으로 자리 잡고 있다. 다문화교육은 본질적으로 다문화인권교육의 성격이 강하다는 점에서 이러한 발전 방향은 긍정적 으로 평가할 수 있겠다. 이 연구에서는 다문화 관련 법률과 조례에 나타난 다문화교육의 성격과 범위 를 비판적으로 검토하여 한계를 지적하였다. 이를 바탕으로 다문화인권교육을 활성화시키기 위하여 다 문화 이해교육에서 다문화인권교육으로의 전환, 다문화사회 관련 종사자들의 다문화인권교육 의무화, 이주민 또는 이주배경 청소년들에 대한 인권교육 등이 제도적으로 정비되어야 한다고 보았다. 아울러 다문화교육지원법의 제정 필요성을 검토하고 이 법이 제정될 경우 다문화인권교육이 보다 활성화될 것으로 전망하였다.
