Korea is quickly changing into a multicultural society. As of 2017, more than two million foreigners are staying in Korea, 3.9 percent of the population. They are required to register themselves with immigration, just as citizens are required to register with government offices. However, the current dual registration system of Korea makes foreigners’ lives difficult and infringes their basic social and economic rights. This research aims to critically review Korea’s dual registration system and propose reformations. This paper consists of fiver sections including the Introduction and Conclusion. Section Two will introduce the foreigner registration procedure under the Korean registration system. Section Three will examine Korea’s human rights commitments and its violation of international legal obligations through the dual registration system. Section Four will analyze possible solutions and objections.

대한민국은 빠르게 다문화 사회로 변하고 있다. 2017년 기준 2백만 명이 넘는 외국인이 대한민국에 거주하고 있으며, 이는 전체 인구의 3.9%에 해당하는 수치이다. 한국에 거주하는 외국인들도 내국인들과 같이 자신을 관공서에 등록해야한다. 그러나, 현재 한국의 이중등록제도는 외국인들의 삶을 어렵게 만들뿐만 아니라, 그들의 기본적인 사회, 문화적 권리를 제한하고 있다. 이 연구는 대한민국의 이중등록제도를 비판적으로 검토하고, 제도를 보완하는데 초점을 맞추고자 한다. 본 논문은 도입과 결론을 포함하여 총 다섯 부분으로 구성되어 있다. 섹션 2에서는 대한민국의 법률 체제 하에서 외국인들의 이중등록 절차를 살펴볼 것이다. 섹션 3에서는 대한민국 헌법 상 인권에 대한 개념과 가치를 검토한 후, 이러한 이중등록제도가 외국인의 인권 보호라는 국제법적 의무를 위반하고 있다는 점을 적시할 것이다. 이를 종합하여, 섹션 4에서는 가능한 해결책과 제시될 수 있는 방안에 대해 분석할 것이다.
