The ways for the resolution of consumer disputes are mutual consent between consumer and business operator, mediation, and lawsuits. In here, we will look into the current situation for the system of consumer lawsuits including the alternative dispute resolution(ADR) both in our country and the foreign countries. Moreover, we will search for the suggestion for the system of consumer lawsuit in our country Our country has the dispute mediation, the class dispute mediation, and the organization lawsuit at Framework Act on Consumers. For instance, the representative system of consumer lawsuit are the class action in the United States and the organization lawsuit in Germany. In Europe, each nation adopts the various systems of consumer lawsuit. Japan has class action and organization lawsuit as the system of consumer lawsuit. In consequence of the search for the system of consumer lawsuit in the various countries, we suggest the improvements for the system of consumer lawsuit in our country : (1) the approval of standing to sue for consumer, (2) the approval of a claim for damages in organization lawsuit, and (3) the adoption of a consumer class action and punitive damages of the United States.

소비자분쟁을 해결하는 다양한 방법으로 당사자 사이에 합의(화해)나 조정, 소송을 들 수 있다. 여기서는 소송외적 분쟁해결제도(Alternative Dispute Resolution ; ADR)를 포함하여 소비자소송제도에 대한 우리나라와 외국의 현황을 살펴보고, 나아가 우리나라에서의 소비자 소송제도에 대한 시사점을 찾아보기로 한다. 우리나라에서는 소비자기본법에서 분쟁조정, 집단분쟁조정, 단체소송이 있다. 외국에서의 대표적인 소비자소송제도로 미국의 집단소송과 독일의 단체소송을 들 수 있다. 나아가 유럽 각국에서도 국가마다 다양한 형태의 소비자소송제도를 도입하고 있다. 일본은 단체소송과 집단소송을 두고 있다. 이러한 각국의 다양한 소비자소송제도를 살펴본 결과로 우리나라에서의 소비자소송제도 의 개선점으로는 단체소송에서의 소비자에게 당사자적격을 인정하고 손해배상청구를 허용하며, 소비자 집단소송을 도입하고 나아가 미국식의 징벌적 손해배상제도도 도입하는 것을 제안한다.
