This article aims to assess the Odebrecht scandal revealed from ‘Lava Jato’ operation since 2014 in Brazil. For years, Odebrecht, the largest construction giant in Latin America, built some of the region’s most crucial infrastructure projects, is involved in one of the biggest corruption cases in history. This study is undertaken to reveal the origin of the irregularities under the framework of demand and supply side of the corruption. The former concerns the current Brazilian politics characterized by multi-party and open-list electoral system, while the latter examines the nature of construction industry, corporate governance and Brazilian (Latin American) politics. In the literature of Latin American corruption, this scandal provides a significant case in that, first, it has happened under liberal democracy; second, it is connected to multi-national infrastructure projects; third, the judicial reform in 2014 which plea bargaining has contributed to the legal solution to the scandal. In conclusion this study will emphasize the importance of political and judicial reform to address the corruption issue.

본 논문은 2014년 이후 브라질을 비롯한 라틴아메리카 정재계를 강타한 오데브레시(Odebrecht) 스캔들을 사례로 하여 라틴아메리카의 정경유착형 부패의 원인에 대한 분석을 목적으로 한다. 기본 가정은 기업과 정치권의 결탁으로 인한 부패관행의 전형을 보인 본 사건이건설업-가족기업-브라질(라틴아메리카) 등 정경유착형 부패를 구성하는 3대 요소가 결합된 취약한 형태를 갖고 있다는 점이다. 이를 위해 업종의 특징, 기업의 지배구조, 라틴아메리카(브라질)라는 정치경제적 토양을 중심 요인으로 분석하고자 한다. 이 사건은 라틴아메리카의 부패논의에 있어 세 가지 측면에서 중요하고 의미있는 사례이다. 첫째, 민주 체제하에서 확대된 부패의 수요에 대한 본질에 접근할 수 있는 사례로서, 이는 브라질의 다당제와 선거제도의 구조적인 모순으로 부패를 조장하는 상황에 대한 분석을 요한다. 둘째, 부패의 공급 측면에서 볼 때특정 업종인 건설 인프라 프로젝트를 중심으로 유사한 패턴의 부패가 다국적으로 발생했다는점에서 업종과 부패 프로세스에 대한 분석을 요한다. 셋째, 반부패 측면에서 본 사건 해결의 단초가 되었던 플리 바게닝 (사전형량조정제도) 등 사법적 대응의 유용성에 대한 접근을 요한다. 본 연구의 결론에서는 지속적인 정치, 사법 개혁의 중요성을 강조할 것이다.
