This study explores ethics of transplantation and the factors that block up the expansion of organ transplantation by korean's cultural perspectives. I examine why the rate of the organ donation of the brain dead is extremely low in comparison with other countries. And the reason why so many koreans are favorable to brain death but negative to organ donation is that Koreans are traditionally negative to body deterioration. And I point out, though the cases has been increasing in terms of the transplantation of the living donor organs, the fact that the patriarchal familism culture penetrates its quality can be a factor to interrupt the realization of the common good in the dimension of ethics. And I point out the fact that secret organ trade has been illegally made so far and that human dignity can be lost in the process of secret organ trade itself. And I search for a practical means to realize the common good through the enhancement of the living quality of the organ failure patients in the last stage by solving the factors that block up the expansion of organ transplantation. Koreans regard brain death as death for the use of organ donation, but they maintain their body undeteriorated because of their belief in the world beyond death, and accordingly, they tend to dislike the deterioration of their own bodies after death.

본 논문은 장기이식에서 발생하는 윤리적 문제와 장기이식의 활성화를 가로 막는 현실적 문제에 대한 해결책을 한국인의 문화적 관점에서 찾아보았다. 논자는 장기이식에 관련된 윤리적 문제에 대한 해법을 서양의 윤리이론에 근거하여 논의하기 보다는 한국인의 영혼관과 신체관 그리고 가족관에 근거하여 찾아보았다. 한국에서 뇌사자의 장기기증에 의한 장기이식이 다른 나라에 비해 극히 낮은 수준에 머무르고 있는 것은 뇌사와 신체훼손에 대한 부정적 인식에 그 원인이 있다. 그리고 생체 장기이식의 수는 증가하고 있지만 그 성격에서 가부장적 가족주의 문화의 영향을 받고 있다. 한국인의 문화적 특성은 현재 운영되고 있는 뇌사와 장기이식에 관련된 법률의 제정에도 많은 영향을 끼치고 있다. 그것은 뇌사자의 장기처분에 있어서 본인의 자율적 의사 보다는 가족의 결정을 우선시하는 법적 규정과 뇌사판정에 대한 법적 규정의 엄격함, 국가가 장기 수혜자를 선정하고 장기이식을 독점 관리하는 것이다. 그리고 장기이식에서 발생하는 윤리적 문제는 생체 장기이식의 경우 장기기증자의 순수성에 대한 문제와 불법적인 장기매매의 문제가 있다. 불법적인 차원에서 이루어지고 있는 장기의 매매는 인간의 존엄성을 상실하게 한다. 본 논문은 한국인의 문화적 인식에 근거하여 장기이식의 확대를 가로막는 여러 가지 요인들을 밝히고, 장기이식의 윤리적 방향과 구체적인 실천적인 방안을 제시하였다.
